Safarik, Vice President Hawaii State Association of Counfies SUBJECT: Approval of 2004 HSAC Legislative Package For your consideration and recommended approval, I am submitting the following proposed legislative items for inclusion in the 2004 HSAC Legislative Package as approved by the HSAC Executive Committee at its meeting on October 10, 2003. Copies of the proposed bills and justification sheets prepared by the county forwarding the recommended bills (for those bills not previously introduced) and provided, as follows: 1. A bill to grant the counties authority to implement a retail sales tax; 2. A bill to increase the time limitations on Council consideration of new applications for affordable housing fast-tracking applications under Section 201G, HRS, and removing the time restrictions on Council consideration of previously approved applications for affordable housing fast-tracking applications; 3. A bill to increase the highway beautification fee from $5 to $10 for litter and junk car eradication programs; 4. A bill to grant the counties authority to implement a driver's license renewal fee for DUI- convicted drivers, with all fees collected being sent to the counties; 5. A bill to require insurance companies to alert the counties when clients cancel no-fault insurance coverage; 6. A bill to require the State to distribute the proceeds of fines and forfeitures collected for uncontested traffic infractions to the county in which the violations occurred; Recommended Action: Motion to approve the above-listed measures as recommended by the HSAC Executive Committee for inclusion in the 2004 HSAC Legislative Package and transmittal of such approval to the HSAC Executive Committee. CALL TO ORDER The HSAC Executive Committee was called to order by President Dain P. Kane at 10:00 a.m. The following members comprised a quorum: County of Maui: President Dain P. EXECUTIVE COMMITTEE MEETING MINUTES The minutes of the August 22, 2003, Executive Committee meeting were approved. It was noted that Mr. Okudara's first name is spelled "Jon." III. REPORTS OF COMMITTEES A. Executive Committee Reports The following Executive Committee Report was approved: 1. Reporting approval of amendments to the expenditures section of the HSAC FY 2003-04 budget approved by the HSAC Executive Committee on August 22, 2003, transmitted by HSAC Secretary Dela Cruz on September 2, 2003. B. County Reports 1. Hawaii County Report. None 2. Honolulu City and County Report. The City and County of Honolulu adopted Resolution 03-228 Requesting State Assistance for Funding County Expenses to Host Conventions of National or International County Government Organizatioris and Resolution 03-243 Concerning the Hawaii State Association of Counties' Nomination to the Western Interstate Region Board of Directors at its meeting of September 24, 2003. 3. Kauai County Report. None 4. Maui County Report. None C. NACo Reports Documents relating to Internet taxation were circulated. D. Western Interstate Region (WIR) Report There was no WIR report. V. UNFINISHED BUSINESS A. Update of HSAC Bylaws President Kane stated it is hoped that proposals for bylaws amendments regarding corporate membership, an executive director position and other matters will be in place by the end of this fiscal year. The main role of the executive director would be to act as chief lobbyist for HSAC on legislative matters at the state and national levels. It is envisioned that the executive director will be a paid position. A possible model for the executive director HSAC Executive Committee Minutes of the October 10, 2003 meeting Page 3 position is Kauai County, which retained a lobbyist to assist in the passage of beach liability legislation. Corporate memberships would assist in funding the executive director position and conferences hosted by HSAC. It was agreed that HSAC staff gather information with respect to executive director positions and corporate membership in other county associations. B. Update of HSAC 2003 Mid-Year Conference Members discussed the 2003 Mid-Year Conference to beheld December 4-5 at the Hapuna Beach Prince Hotel. A draft conference schedule and a brochure of the Hapuna Beach Prince Hotel were distributed. The therne of the conference will be "E Holomua Kakou No Ka Pono (Government Working Together for All)." Suggestions were made regarding conference topics, speakers, and arrangements. The Executive Committee approved a request from Hawaii County for $1,000 in seed money for the conference. At 11:07 a.m., President called a recess. At 11:20 a.m., the meeting was reconvened. C. Update of 2005 NACo Conference The minutes of the 2005 Conference Planning Committee meeting of August 22, 2003, were received. Secretary Dela Cruz clarified that the sketches for the HSAC logo will be provided by the City and County of Honolulu on an in-house basis. D. WIR Board Representation All counties reported approval of the request to replace Councilmember Donovan Dela Cruz with Councilmember Gary Safarik as WIR board representative. E. 2004 HSAC Legislative Package The members received: (a) a memorandum from President Kane to members of the HSAC Executive Committee dated August 29, 2003, related to 2004 HSAC legislative matters, (b) a memorandum from Councilmember Djou to Councilmember Dela Cruz, dated September 9, 2003, relating to 2004 HSAC legislative matters, and (c) a letter from Councilmember Romy Cachola to Secretary Dela Cruz dated September 12, 2003. HSAC Executive Committee Minutes of the October 10, 2003 meeting Page 4 A copy of the latest version of the "county sales tax" bill (ref.: county tax6.doc) and a summary of the proposed bill were distributed. Secretary Dela Cruz stated that the Honolulu Council is considering resolutions relating to the "Walk and Talk" program and the "ice" drug problem. President Kane suggested that at a later time HSAC may review the administrative packages of offices such as the Prosecuting Attorneys and decide whether to support certain package items. At 12:00 p.m., Presideni; Kane called a recess. At-12:03 p.m., the meeting was reconvened. Secretary Dela Cruz stated that Councilmember Cachola has requested HSAC to (1) consider the issue of reduced transient accommodations tax (TAT) revenues when a transient accommodations unit is converted to a time share unit, and (2) discuss alternative ways in which the counties may impose the real property tax on such a converted time share unit to recoup the lost TAT revenues. The members indicated that they would be interested in considering proposed legislation to deal with the issues raised in Councilmember Cachola's letter at the next HSAC Executive Committee meeting. President Kane stated that the Maui Council is considering proposing a "instant impound" law for illegal and uninsured vehicles and legislation to increase funding for school crossing guards. After much discussion, the Executive Committee referred to the city and county councils for their approval the following proposed legislative items for inclusion in the 2004 HSAC Legislative Package: 1. Granting the counties authority to implement a retail sales tax 2. Increasing the time limitations on council consideration of new application for affordable housing fast-tracking applications under Section 201 G, HRS, and removing time restrictions on council consideration of previously approved applications for affordable housing fast-tracking applications 3. Increasing the highway beautification fee from $5 to $10 for litter and junk car eradication programs 4. Granting the counties authority to implement a driver's license renewal fee for DUI-convicted drivers, with all fees collected being sent to the counties HSAC Executive Committee Minutes of the October 10, 2003 meeting Page 5 5. Requiring insurance companies to alert the counties when clients cancel no fault insurance coverage 6. Distributing fine proceeds from unadjudicated traffic violations to the counties Secretary Dela Cruz commented that there is a need for HSAC to discuss the issues addressed by the HSAC legislative package through forums such as newspaper editorials. President Kane stated that justification sheets and bills will be prepared by the staff of the council body that initially proposed the respective legislation. The members discussed the meeting with Senator Kim on October 24 to consider proposed county sales tax legislation. The members agreed to circulate communications to their respective bodies requesting their support for the legislation. The Executive Committee approved an amendment to Section 10 of the HSAC bylaws to read as follows: `The Executive Committee shall determine the strategy for the corporation's efforts before the State Legislature. An Executive Committee officer or designee shall testify before the Legislature on proposals in the corporation's legislative package. The Executive Committee may add legislative items to the HSAC Legislative Package during fhe legislative session if the measures promote the counties' home rule authority and/or increase the counties'revenues." VI. NEW BUSINESS A. Agricultural Land Use Vice President Safarik expressed his interest in legislation that would enable the counties to have more control over agricultural land use decisions. The members agreed to consider the issue next year. VII. COMMUNICATIONS The following communication was received: A. Correspondence dated May 12, 2003, from Senator Daniel K. The bill is drafted to attempt to avoid conflict with the Streamlined Sales and Use Tax Agreement by applying it only to retail sales in Hawaii and exempting interstate and foreign commerce. The authority to establish a use tax is deleted. The use tax is an excise tax on the use of tangible personal property "which is imported" or purchased from an unlicensed seller, for use in this State. The bill provides that a county shall establish the general excise tax by ordinance. A county general excise tax cannot be established on: (1) Sales taxable at the one-half per cent rate under Chapter 237 (manufacturers and wholesalers); (2) Sales taxable at the 0.15 per cent rate under Chapter 237 (insurance solicitors and agents); (3) Wholesalers and jobbers as defined in section 237-4; (4) Sales from interstate or foreign commerce; (5) Sales exempt from Chapter 237. If a county with a population of two hundred thousand of more enacts a county general excise tax, the distribution of the transient accommodations tax revenues (using Council of Revenues FY05 projections) would be as follows: (1) 20.3 per cent into the Convention Center Enterprise Special Fund (repeals the $31 million cap on the Fund -the Fund would receive approximately $35.5 million); (2) 35.0 per cent into the Tourism Special Fund (requires $1 million to be distributed for state parks and trail and access, and 1 per cent of the revenues in the Fund to be used for visitor industry promotion and marketing in the City and County of Honolulu -the Fund would receive approximately $66.5 million) (3) 10.20 per cent of transient accommodations revenues to Kauai County (approximately $17.85 million-Kauai now at $11.37 million); (4) 13.10 per cent of transient accommodations revenues to Hawaii County (approximately $22.93 million -Hawaii now at $14.58 million); (5) 16.10 per cent of transient accommodations revenues to Maui County (approximately $28.18 million -Maui now at $17.88 million); and (6) 2.3 per cent of transient accommodations revenues Yo the general fund. (approximately $4.02 million) If more than one county establishes the county general excise tax, transient accommodations tax revenues are distributed as follows: (1) 20.3 per cent to the Convention Center Enterprise Special Fund (This should amount to about $35.53 million); (2) 40.0 per cent to the Tourism Special Fund (This should amount to about $70 million -requires 1 per cent of the revenues in the Fund to be used for visitor industry promotion and marketing in the counties enacting the county general excise tax.); (3) 15.0 per cent to each county not establishing a county general excise tax (This amounts to about $26.25 million.); and (4) Moneys remaining after the revenues are distributed above, shall be deposited into the general fund. (This should amount to about $16.98 million.) The counties are required to use one per cent of the TAT revenues that are transferred for tourism promotion and marketing. .B. NO. HSAC supports legislation authorizing additional time to consider affordable housing applications for the following reasons: 1. The development of affordable housing for residents is vital and necessary to ensure that the working people of our State can continue to call Hawaii home. Developers rely upon the exemptions from development standards authorized under Section 201G-118, HRS, to lower costs associated with the project. Expediting legislative review and approval of a project also represents a cost savings to the developer and reflects the priority given affordable housing. However, in limiting the window for legislative approval to 45 days, the body is denied an adequate opportunity to review and consider an application. Often the scope of the project and requested exemptions warrant a site inspection. Posting requirements and availability of meeting dates before the appropriate committee and the council pose additional constraints in meeting the 45-day period. 2. Under the current scheme, it a project is not disapproved within 45 days, it is automatically deemed approved on the 46 day. If the council generally supports a project but wants public comment on a proposed change, it may be hard-pressed to either disapprove the project due to lack of time to receive such comment, or to accept the project as is. Increasing the period for approval or disapproval by 30 days would provide the council with the ability to have, and receive, meaningful input on the project, while maintaining an expedited review process. 3. Finally, the bill clarifies that the applicant is not entitled to repeatedly demand expedited review. The bill adds a new subsection (a)(3)(B) to make explicit that the fast-track process outlined in Section 201G-118 does not apply to previously approved projects for which amendments are being sought. HSAC supports such legislation for the following reasons: 1. The counties are responsible for abandoned or derelict vehicles on public highways. In recent years, there have been significant increases in both the number of abandoned or derelict vehicles and the costs involved in disposing of them. 2. Abandoned or derelict vehicles left on public highways is a public safety issue that requires prompt attention and resolution. These vehicles may contribute to unsafe driving conditions as well present opportunities for vandalism and arson. In addition, such vehicles have a negative visual impact for both residents and tourists that travel on our public highways. Increasing the maximum fee will ensure that the counties will have the resources to address this problem. The fee shall cover the costs incurred by the counties' police departments to prepare for and attend administrative hearings or judicial proceedings. HSAC supports such legislation for the following reasons: 1. Operaiing a vehicle under the influence of an intoxicant is a serious public safety issue that may have devastating results. Those who drive under the influence of an intoxicant should be required to pay their fair share of the costs incurred by the counties' police departments related to the offense. 2. Requiring offenders to pay an additional fee may help to deter driving under the influence of intoxicants. HSAC supports such legislation for the following reasons: 1. Requiring motor vehicle insurers to notify the police department of cancelled or non-renewed insurance will assist the police in assuring that only insured vehicles are operated on public roadways. 2. It is crucial that all motor vehicles operated on public roadways are insured in order to provide reparations for accidental harm and loss arising from motor vehicle accidents, to compensate damages without regard to fault, and to limit tort liability for these accidents. 3. It will be more difficult for fraudulent motor vehicle insurance cards to be used. The purpose of the bills is to require the State to transfer fines and forfeitures col?ected for uncontested traffic infractions to the county in which the violations occurred. HSAC supports these bills for the following reasons: 1. While the counties are responsible for enforcement, revenues accruing from violations of the Statewide Traffic Code are paid solely to the State. Traffic citations are issued by police officers whose costs, including salaries, equipment, and administrative support, are funded by the counties. Allowing each county to receive the fines and forfeitures generated as a result of county enforcement of traffic laws is fair and will provide the counties a much-needed modicum of financial relief from the State. The measure specifically excludes those fines and forfeitures accruing from State-enforced violations, which do not involve the expenditure of County resources. 2. When traffic violations remain uncontested, there is no need to resort to the State courts. The burden on State-funded personnel and resources is, therefore, minimized. The bill seeks solely to have those fines and forfeitures paid by offenders without contest transferred to the county in which the infraction occurred. 3. Authorizing the counties to collect such fines and forfeitures would provide the counties with a dedicated revenue source and diversify the counties' revenue bases. As a result, the measure would help to stabilize the counties' budgets and promote the viability of the counties' public services, including the provision of traffic-safety improvements. While in full support of the bills, HSAC requests consideration of an amendment to Section 2 of the bills, to conform to the definitions provided in section 291 C-A. The amendment would read, "The judiciary shall identify those fines and forfeitures for uncontested [fines] traffic infractions as defined in section 291 C-A."
