RESOLUTION NO. 128 03
RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR LEASE OF
REAL PROPERTY FOR THE PROSECUTING ATTORNEY'S WAIMEA OFFICE
WHEREAS, Section 10-11 of the County Charter requires that any contract, lease, or other
obligation requiring payment of funds from the appropriations of a later fiscal year and more than one
fiscal year be approved by resolution; and
WHEREAS, the police station in Waimea has been providing office space and support for one
Deputy Prosecuting Attorney for several years but is now in need of that space for their own
operations; and
WHEREAS, the Office of the Prosecuting Attorney has found 600 square feet of office space in
the Holomua Center, 64-1067 Mamalahoa Highway, Waimea, Hawaii; which is adequate for its
needs as it is across from the police station and in close proximity to the court; and
WHEREAS, the County wishes to enter into amulti-year lease with Clark Realty Corporation
for five (5) years starting January 1, 2004 and ending on December 31, 2008; at a rental rate of $1.25
per square foot for the first year and increases by $.04 per square foot each year of the lease, plus an
estimated $.35 per square foot common area maintenance charge.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
1. That the Mayor is hereby authorized to enter into amulti-year lease agreement for office
space for the Office of the Prosecuting Attorney.
2. That sufficient funds be budgeted in future fiscal years to cover the anticipated obligations
of the County under the lease agreement.
EE IT FURTHER RESOLVED that a copy of this resolution be transmitted to the Department
of Finance and the Office of the Prosecuting Attorney.
