Re: Operating Budget
Enclosed is a bill for an ordinance amending the Operating Budget by appropriating funds
from the Solid Waste Fund's fund balance account into the Landfills OCE account. The
additional funds are needed for refuse cover materials in order for the County to comply
with Federal and State of Hawaii Department of Health (DOH) regulations. The amount
originally budgeted for cover material was based on past usage and is not sufficient to
achieve regulatory compliance.

A. REQUEST:
To appropriate the Solid Waste Fund balance of $312,215 to 085-601-5604.02-229 Landfills OCE -Building
& Construction Material.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Additional funds are needed for refuse cover material in order to comply with Federal and State of Hawaii
Department of Health (DOH) regulations. The amount budgeted for ground cover material for fiscal year
2003-2004 is not sufficient to achieve regulatory compliance. The current budget was based on past usage
which was found to be inadequate by DOH. Violations due to inadequate refuse cover resulted in fines
assessed against the County and resulted in the County entering into a "Consent Agreement" with DOH.
The consent agreement requires the County to document compliance with the refuse cover regulations.
