From Council Vice Chair J. Curtis Tyler, III, dated November 20. 2003, transmitting the
above resolution. Prepared in close consultation with key private landowners and the
National Park Service and reviewed by Environmental Management Director Barbara Rell
and Wastewater Division Chief Peter Boucher, the thrust of this initiative is to facilitate
sewerage improvements in the rapidly developing Kaloko Industrial Area and to plan and
consider the greater regional needs of this important section of North Kona coastline. Also
requests that Resolution 70-01, related to Resolution 129-03, which was deferred at the
May 2, 2001 meeting of the County Council, be filed.

bill. 'fhe above-mentioned project of the Hawaii County Police Department was initiated to
replace the existing microwave communications system used by a variety of public safety
agencies, and involves the analysis of the current facilities, agreements with co-locators,
acquisition of tower sites, tower modifications and new tower construction, equipment
purchase and installation, and ultimately the transition to the new equipment This
appropriation is for the pn~ject's upgrades to allow co-locators to the microwave system, wfio
will reimburse the County for costs incurred to add them to the system.

bill. The additional funds, being appropriated from the Solid Waste fund's fund halancc
account are needed for refuse cover materials in order for the County to comply with Federal
and State of Hawaii Department of f lealth (DOH) regulations. The amount originally
budgeted for cover material was based on past usage and iv not sufficient to achieve
regulamry compliance.

From Finance Director William Takaba, dated November 19, 2003, transmitting the above
bill. Informs of the history of the Shippers' Wharf Committee, which was legally dissolved
in 1953. Administration of the corporation's assets was transferred to the Governor of the
State of I Iawai'i; and in April 2001, an Order of the l~hird Circuit Court translerrcd the duty
of administering die "trust to the State Director of Finance with a provision That established a
committee to review applications for trust fund disbursements and annual accounting by the
Attorney General. In October of 2003. the'Fhird Circuit Court approved the transfer of the
fund from the State of Hawaii to the County of Hawaii and designated the Mayor as ib
l7ustee. l'he establishment of this fund within the Havvai'i County ('ode allows the County
to administer the funds of the Shipper's Wharf Committce Trust Fund, as instructed under the
provisions of the April 2001 Order of the ~fhird Circuit Court.

i lo'okena Community Water Association (HC WA) ov`ns the current 5/R" water meter and
will install a larger I'/"water meter. On busy hcach days. the water system cannot provide
sufficient water for the part. and HC W A residents, and some of the natures in the park
cannot be utilized due to lac6 of water pressure. The improvement should provide par6 users
with continuous restroom and shower conveniences. l-his appropriation represents the
Countp's share of the replacement costs.
