RESOLUTION NO. 94-97
This is in reply to your memorandum of August 24, 1998 asking
whether the Police Department is obliged to comply with
conditions imposed in a resolution. We respond in the negative.
The Police Department reviews its various programs on a regular
basis. We consider that to be part of our management
responsibility. Such reviews, however, do not meet the
requirements of Article III, Section 3-16 of the Charter, which
clearly contemplates an independent outside review by the
Council.
While we respectfully do not acknowledge the authority of the
Council to dictate the management practices of the Police
Department by resolution, we will be happy to provide any data
which the Council may need to assist in evaluating the
effectiveness of the marijuana eradication program as indicated
in our earlier memorandum of June 23, 1998 to the Legislative
Auditor.
