Re: Resolution for amulti-year contract
Enclosed is a resolution authorizing the payment of funds of a later fiscal year and of
more than one fiscal year for an organics diversion program. Pursuant to the State of
Hawaii Department of Health's Administrative Rules, the County of Hawaii is required
to have a diversion program for greenwaste.

A. REQUEST:
A resolution authorizing the payment of funds of a later fiscal year and of more than one fiscal year for an
organics diversion program.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Whereas, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring
payment of funds from the appropriations of a later fiscal year or more than one fiscal year be approved by
resolution, and
Whereas, it is essential for the County of Hawaii to have an organics diversion program that accepts green
waste, food waste, and untreated lumber for the production of a value-added compost product, and
Whereas, RFP 2036 to Furnish and Implement an Organics Diversion and Composting Program was published
on March 16, 2003, and
Whereas, pursuant to DOH § 11-58.1-65 (b) it is required that the County of Hawaii have a diversion program
for greenwaste, and
Whereas, the County of Hawaii wishes to enter into a five (5) year contract for organics diversion with an option
to renew for an additional five (5) years.
Now, therefore, be it resolved by the Council of the County of Hawaii that the Mayor is hereby authorized to
enter into a five (5) year agreement with option to renew for an additional five (5) years for an organics
diversion program and that sufficient funds be budgeted in future fiscal years to cover the anticipated
obligation of the County of Hawaii under the terms of the agreement.
