'03 NOU 18 R(9 8 O1 Hilo, HI 96720 COUi~~ ~.,1_=.,~: Council Member Elarionoff: COUN7Y : ~i= }igWA~l 1 am writing this letter to express my opposition to the proposed rezoning of 14.5 acres adjacent to the Kona Heights subdivision (SLU 03-007/REZ 03-018). I request that the County Council conduct their hearing on this matter in Kona. In their November 7~' meeting, the Planning Commission voted against Applicant Nani Kona Aina's requested rezoning of 14.5 acres of land from Agricultural (A-Sa) to Urban (RS-10). This was item #4 c„ their agenda, reference SLU 03-007/REZ 03-018. The commission voted 5-2 to deny the requested rezoning. I understand that the proposed rezoning will now be presented to the County Council. There are currently 400-500 homes in the "Kailua-View Estates" area, mauka of Kona town. This area has only one access road, Nani Kailua. There have already been approvals for numerous adjacent areas to allow the addition of 75-100 homes which will also utilize the single access road, Nani Kailua. This new request would add an additional 43 homes. Since each requested rezoning has been under the 100 lot threshold, no impact studies have been required. In addition, the developer's proposed lot map would put 43 homes close to (or in) a flood plain, all relying on one access road to the existing Nani Kailua road. This raises concerns about the potential for ground water contamination from sewage tanks/cesspools and issues with emergency access. I have talked with many of my neighbors. They are all opposed to this specific rezoning. Everyone has also expressed concern about the continued "incremental rezoning" development in our area. It does not seem to be "within the spirit of the law" for developers to continue rezoning small developments and thereby avoiding any impact studies and related infrastructure costs. We think this should stop. Please conduct the County Council hearing on this matter in Kona so the affected residents can attend the meeting. In addition, I strongly urge that you oppose this rezoning. No further development should be approved in the "Kailua View Estates" area until studies are completed and solutions developed for all infrastructure impact.
