We wish to take advantage of the excess revenue collected and appropriate it to the Self Insurance Fund, to cover existing obligations and to the Solid Waste Fund, for ground cover materials at the South Hilo landfill and for litter control at the West Hawaii landfill. The Self Insurance Fund is used to pay for settlements in excess of $1,000,000 when authorized by the Council. Two large settlements, in the current and prior year, require the transfer of $1,000,000 to this fund to meet its obligations through June 30, 2005. In accordance with the South Hilo Sanitary Landfill Consent Agreement between the State of Hawaii Department of Health and the County of Hawaii, Department of Environmental Management, Solid Waste Division, the County has agreed to provide corrective actions for storm water management, cover materials requirements, control of wind-blown litter and hazardous waste screening requirements. The additional funds requested are needed to comply with the conditions of the Consent Agreement. In accordance with the State of Hawaii -Department of Health Solid Waste Management Permit for operation of the West Hawaii Landfill, litter control is required. The County is required to control the migration of litter from the active waste disposal area. Litter that migrates from the active waste disposal area must be collected and disposed prior to leaving the landfill property boundary. County's efforts currently include the use of litter control fencing, labor, and equipment to control the migration of litter from the active waste disposal area. Currently, funds expended for litter control at the West Hawaii Landfill are in excess of that amount originally estimated for the fiscal year 2003-04. In order to maintain regulatory compliance and satisfy the requirements of the landfill operation contract with Waste Management, Inc., additional funds are being appropriated. Comm. To:~G Rif. date Utl_~~~ Honorable James Arakaki, Chairperson Page 2 December 18, 2003 Enclosed are two (2) bills for an ordinance amending the Operating Budget, one bill increases the Real Property Taxes, Penalties, and Interests accounts by $1,500,000 and then appropriating it to Self Insurance and Solid Waste Funds and the other bill increases the Solid Waste Fund's Transfer from General Fund account by $500,000 and appropriating these funds to the landfill accounts.
