ORDINANCE NO.
A BILL FOR AN ORDINANCE AMENDING CHAPTER 2 OF THE HAWAFI COUNTY CODE 1983
(1995 EDITION), ADMINISTRATION, RELATING TO THE ESTABLISHMENT OF A DISASTER
AND EMERGENCY FUND.
BE IT ORDAINED BY'I'HE COUNCIL OF THE COUNTY OF HAWAII:
SECTION I. Purpose. The County Council finds that there is a need to create a special fund to
provide immediate response to repair county facilities and infrastructure due to damages caused by a natural
or man-made disaster or other emergencies, and to clean up property when such action serves a public
purpose.
SECTION 2. Chapter 2 of the Hawaii County Code, 1983 (1995 Edition), relating to
Administration, is hereby amended, by the addition of a new article to read as follows:
"ARTICLE UISASTER AND EMERGENCY FUND.
Section 2-_. Creation of Fund.
Pursuant to section 10-12, Hawaii County Chaster, a special fund to be known as the
Disaster and Emergency Fund is created.
Section 2-_. Funding.
The Disaster and Emergency Fund shall be funded each fiscal year by the council appropriating a
minimum of $100,000 to a maximum of$1,000,000 per year until the Fund has accumulated a
maximum of $5,000,000.
Section 2-_. Expenditures from the Disaster and Emergency Fund.
The moneys in the Disaster and Emergency fund shall be only utilized for the following
purposes:
(a) To repair county facilities and infrastructure damaged by a natural orman-caused
disaster or emergency.
(b) 'Fo clean up property, including roads and sewage systems, damaged ny a natural or
man-caused disaster or other emergencies when such action serves a public pm~pose.
(c) To provide immediate response for services to deal with public health and safety risks
due to a natural or man-caused disaster or emergency in the form of personnel,
equipment, materials, supplies, and service contracts.
(d) To match federal, state, and/or private grants-in-aid to develop or restore public property
to a safe and useable condition.
(e) 'fo pay for administrative expenses, which shall not exceed five percent (5%) of this
Fund.
Section 2- .Dissolution of the fund.
fhe Disaster and Emergency fund shall not be dissolved unless such dissolution is approved
by a two-thirds vote of the County Council.
Section 2- .Reimbursement from grants.
If the County should receive reimbursement for money advanced by the Disaster and
Emergency Fund, the grant money shall return to the Disaster and Emergency Fund.
Section2-_. Administration of the fund.
The Director of Finance shall administer the Disaster and Emergency fund, which shall
include investment of the fund."
SECTION 3. Material to be repealed is bracketed. New material is underscored. In printing this
ordinance, the bracketed material need not be included.
SECTION 4. If any provision of this ordinancq or the application thereof to any person or
circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance
which can be given effect without the invalid provision or application, and to this end the provisions of this
ordinance are severable.
SECTION 5. This ordinance shall take effect in the fiscal year following its approval.
