A BILL FOR AN ORDINANCE AMENDING CHAPTER 2 OF THE I1AWAl`l COUN"I'Y CODE 1983 (19)5 EDITION), ADMINISTRATION, RELATING TO THE ESTABLISHMENT OF VOLUNTEER FIRE STATIONS. BE IT ORllAINED BY THE COUNCIL OF THE COUN"I'Y OF HAWAII: SECTION 1. Purposes According to section 46-13.1, Hawaii Revised Statutes, the county council may establish and maintain one or more volunteer fire statiais in any area or areas of the county as it may determine to be necessary to provide adequate fire protection. While some volunteer fire stations may require monies to be budgeted, others may not. For this reason, it is important that the location of all volunteer fire stations he specified by law in order for the council and the general public to know where these stations would be sited. "this ordinance will also correct Section 2-17, liawai`i County Code, I-lead of volunteer fiire department, which has inadvertently named a position that the fire department does not have. SECTION 2. Chapter 2, Article 6 of the Hawaii County Cade, 1983 (1995 Edition), relating to Volunteer Fire Department, is hereby amended, by the addition of a new section to read as follows: "Section 2-16.1 Volunteer fire stations. In accordance with provisions of section 46-13.1, Hawaii Revised Statutes, the following volunteer fire stations are established in the County of Hawaii to be sited and ouerated by the head of the volunteer fire department pursuant to powers granted under this article: I. Pepe`ekeo volunteer fire station. 2. Kulani volunteer fire station. 3. Volcano volunteer fire station. 4. Hawaiian Acres volunteer fire station. 5. Fern Forest volunteer fine station. 6. Fern Acres volunteer fire station. 7. Miloli`i volunteer fire station. 8. Kona Paradise volunteer fire station. 9. Kona Villaee volunteer fire station. 10. Kati pulehu volunteer fire station. 1 I . Pour Seasons volunteer fire station. 12. Pa`auilo volunteer fire station. 13. Waiki`i voluntccr fire station. 14. Hawaiian Beaches volunteer fire station. I5. Wa`awa`a voluntccr fire station. I6. Na`alehu volunteer fire station. 17. Hawaiian Ocean View Estate volunteer fire station. 18. Discovm~y Harbor voluntccr fire station. 19. Pahala voluntccr fire station. 20. North Kohala Coast volunteer tire station. 21. Waikoloa volunteer fire station. 22. Laupahoehoe volunteer fire station. 23. Paradise Park volunteer fire station." SECTION 3. Chapter 2, Article 6 of the Hawaii County Code, 1983 (1995 Edition), relating to Volunteer Fire Department is hereby amended. "Section 2-17. Head of volunteer fire department. (a) The [s4~ief-e~g++3eee] fire chief of the County fire department shall be the head of the volunteer fire department. The head of the volunteer fire department shall: (1) Be vested with the management and control of the affairs, personnel, and property of the department, subject to the general authority and control of the council. (2) With the consent and approval of the council, make expenditures of moneys appropriated by the cowicil for the department; (3) Not conh~act any debt on behalf of the department, not dispose of any property belonging to the department without the consent of the council; (4) Make periodic reports to the council concerning the affairs and activities of the department; and (5) Perform and discharge such other duties as may be assigned to him by the council." SECTION 4. Material to be repealed is bracketed. New material is underscored. In printing this ordinance, the bracketed material need not be included. SECTION 5. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable.
