Home My WebLink AboutRES 145 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 145 04 RESOLUTION AUTHORIZING THE OFFICE OF THE MAYOR TO ENTER INTO AN AGREEMENT WITH THE HAWAII COMMUNITY FOUNDATION, PURSUANT TO HRS 46-7, FOR THE COMMUNITY ORIENTED POLICING SERVICES (COPS) GRANT FOR THE HAWAII COUNTY POLICE DEPARTMENT WHEREAS, the Hawaii Island Meth Initiative is a joint effort of U.S. Senator Daniel K. Inouye, the Hawaii Community Foundation, and the County of Hawaii to respond to the overwhelming concern of the community to the devastating effect that ICE or crystal methamphetamine is having on our children, our families, and our communities; and WHEREAS, through the successful efforts of Senator Inouye, monies were put into the budget of the U.S. Department of Justice, assigned to its Community Oriented Policing Services (COPS) agency, passed through the Hawaii Community Foundation (HCF), and awarded to selected County of Hawaii Departments and community agencies; and WHEREAS, the Hawaii County Police Department is one of the recipients of the COPS Grant and intend to use their funds in the area of enforcement by creating additional positions for its ICE task force, by acquiring vehicles for it drug and search warrant raids, and by setting up a new drug smuggling unit at the Keahole International Airport; and WHEREAS, Hawaii Revised Statutes, Section 46-7, requires that county departments obtain the consent of the council to enter into agreements with the federal or state governments respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to those powers. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in accordance with section 46-7, Hawaii Revised Statutes, that the Mayor of the County of Hawaii is authorized to execute, on behalf of the County, the Hawaii Community Foundation Award Agreement, attached hereto and incorporated herein by reference as Exhibit "1" to enable the Hawaii County Police Department to use their funds in the area of enforcement by creating additional positions for its ICE task force, by acquiring vehicles for its drug and search warrant raids, and by setting up a drug smuggling unit at the Keahole International Airport. SE IT FURTHER RESOLVE® that the Mayor of the County of Hawaii is authorized to sign the above-referenced agreement and any related documents on behalf of the Office of the Mayor and the County of Hawaii pursuant to the Hawaii County Charter. ~E IT FURTHER RES®LVED that the County Clerk of the County of Hawaii shall transmit copies of this resolution to the Hawaii Community Foundation, the Office of the Mayor and to the Departments of Finance and Police. The project is funded by the U.S. Department of Justice, Community Oriented Policing (COPS) federal grant program (the "Federal Grant") and is subject to the conditions of that program. We are excited about your project and believe it is the kind of work that can help to make a difference in Hawaii. Proposal ID#: Grant Award: $525,912.00 Grant Period: (March 8, 2004 to March 7, 2005) Grant Purpose: Addressing the Crystal Methamphetamine "ICE" Problem in Hawaii County Please read the following grant conditions carefully: ? This grant is to be used only for the purposes set forth in the proposal and work plan you submitted to HCF for the Hawaii Island Meth Initiative (the "Proposal"). If there is any change in any of the activities described in the Proposal, please contact us before expending the funds. ? As grantee, you acknowledge that the grant is being made in connection with the Federal Grant. You further acknowledge and agree that you are familiar with the requirements and conditions of the Federal Grant and agree to comply with all requirements that may be applicable to your organization as asub-recipient of the Federal Grant. ? The grant will be paid in increments as set forth in Exhibit "A". All deliverables funded by prior increments must be completed before additional grant increments will be paid. Any exceptions must be requested and approved by HCF in writing in advance of the deadline. ? A grant activities report and financial report are required to be submitted to HCF quarterly in order to administer the grant and maintain necessary expenditure records. Deadlines for the quarterly reports are set forth in Exhibit A. ? HCF reserves the right to require site visits while the project is in progress and/or once the project has been completed. ? You must notify HCF of any unexpended funds at the end of the grant period, or if (i) your organization has not performed in accordance with the Proposal or this agreement, (ii) your organization loses its exemption from federal income taxes under Section 501 (c) (3) of the Internal Revenue Code, or (iii) your organization materially changes its programs, activities or mission. ? You acknowledge that the services provided in connection with the Proposal are provided solely as a grantee and there is no principal/agent or employee/employer relationship between your organization and HCF. ? Should you publicize the receipt of this grant, please send a copy of any articles, video taped television coverage, annual reports, or similar publications to the HCF Communications Officer.
