Attached for your favorable consideration is Drafr 4 of proposed Resolution No. 55-03 supporting the preservation and conservation of Wao Kele `O Puna. We ask that Draft 4 amend previously submitted drafrs. The following WHEREASES were deleted from the body of Resolution No. 55-03 (Draft 3): 2"d WHEREAS, geothermal development activities were conducted in Wao Kele `O Puna, including the building of roads, the clearing of a development site, and creation of geothermal waste holding ponds and the drilling of one or more exploratory geothermal wells at the development site; and 3rd WHEREAS, the Estate of James Campbell and True Geothermal Energy Company were obligated by the permits issued by agencies of the State of Hawaii to conduct certain remedial activities in regard to their permitted geothermal activities; and ReS. Uote~__~~ 4°i WHEREAS, the Estate of James Campbell and "Erne Geothermal Energy Company, a Wyoming general partnership, has abandoned its plans to develop geothermal energy in Wao Kele `O Puna; and 8"' WHEREAS, certain nonprofit groups have expressed interest in purchasing Wao Kele `O Puna for the purpose of preserving the land, and protecting its ecology and the traditional uses associated therewith; and The NOW, THEREFORE, BE IT RESOLVED has been changed to read: NOW, THEREFORE, BE [T RESOLVED that the IIawai`i County Council supports the effort by conservation groups working to acquire Wao Kele `O Puua, for purposes of preservation and protection] BY THE COUNCIL OF THE COUNTY OF HAWAI"I that Kovernment officials and agencies of Hawaii County and the State of Hawaii are encouraged to support the effort by conservation groups working fin consultation with the Pele Defense Fund1 to acquire Wao Kele `O Puna since the county views this acquisition as a hieh priority that will promote county and state interests, the }general welf~ire and county and state goals to protect important conservation lands The following BE IT FURTHER RESOLVED has been deleted: BE IT FURTHER RESOLVED that government officials and agencies of Hawaii County and the State of Hawaii are encouraged to support the effort by conservation groups working to acquire Wao Kele `O Puna, since the cowity views this acquisition as a high priority that will promote county and state interests, the general welfare, and county and state goals to protect important conservation lands; The BE I1' FINALLY RESOLVED has been changed to read: BE IT FINALLY RESOLVED that the County Clcrk transmit copies of this resolution to the Honorable [George W.
