Enclosed is a memorandum dated August 29, 2003 from Dain P. Kane, President, requesting our Council's consideration of the proposed HSAC By-Law amendment to incorporate the Legislative Program Policy Statement. Action requested: Ameud the HSAC By-Laws to allow the HSAC Executive Committee to add legislative items to the HSAC Legislative Package during the legislative session if the measures promote the counties' home rule authority and/or increase the counties revenues. Action to amend the HSAC By-Laws is advisable before the next HSAC Executive Committee meeting scheduled for February 13, 2004. HSAC will also be reviewing legislation at that meeting for possible inclusion in [he 2004 HSAC Legislative Package, so timely approval is crucial. It is therefore advantageous [hat approval is granted for these matters to be placed onto the nest Council agenda for review. However, in the event this request is denied, for whatever reason, I understand the matter shall be referred to the Committee on Public Works and Intergovernmental Relations for lace ent on its future agenda. Kane, President Hawaii State Association of Counties SUBJECT: 2004 HSAC LEGISLATIVE MATTERS Please ask your Council to consider the following: 1. Legislative Package Bills. At our meeting of August 22, 2003, the following possible bills were discussed for inclusion in the package: a. Granting the counties authority to implement a retail sales tax; b. Increa g the time limitations on Council consideration of new ap s for affordable housingfast-tracking applications un n 201 G, Hawaii Revised Statutes, and removing the tricti uncil consideration of previously approved applica kons . ~ da le housing fast-tracking applications; c. For the past several years, the Councils, the Executive Committee, and ultimately, the General Membership have adopted a Legislative Program Policy Statement. y.~~~,,` O Jan-26-04 02:07P Council Sorv ices P_03 Members of the HSAC Executive Committee August 29, 2003 Page - 2 - However, for the upcoming legislative session and future sessions, I would like to propose an HSAC Bytaw amendment to incorporate the Statement into our guiding documents. The proposed amendment under Section 10 will read as follows: "The Executive Committee shall determine the strategy for the corporation's efforts before the State Legislature. An Executive Committee Officer or designee shall testify before the Legislature on proposals in the corporation's Legislative package. The Executive Committee may add legislative items to the HSAC Legislative Package during the legislative session if the measures promote the counties' home rule authority and/or increase the counties revenues." 3.
