Shimizu, CPA Managing Partner Branclek, LLP 58 Kamana Street Hilo, HI 96720 Dear Mr. Shimizu: Change of Zone Ordinance No. 02 48 (REZ 978) Applicant: Branclek, LLP Subject: Administrative Time Extension Tax Map Kev: 2-2-22: 6 Thank you for your letter dated January 20, 2004 requesting a time extension to comply with Condition B of Change of Zone Ordinance No. 02 48 (REZ 978). Condition J (4) allows for one administrative time extension for a period not to exceed the period originally granted. We are therefore granting a time extension of two (2) years until April 16, 2006. We do have the following comments regarding compliance of the listed conditions: Condition B: Final Plan Approval was required to be secured within two (2) yeazs from the effective date of ordinance (April 16, 2002). The time extension will extend this requirement until April 16, 2004. Condition D: An approved Solid Waste Management Plan is required to be submitted to the Planning Department prior to the issuance of Final Plan Approval. Condition F: As a reminder, prior to the issuance of a certificate of occupancy for a new commercial structure, the applicant shall construct full improvements to the entire frontage along Kamana Street meeting with the approval of the Department of Public Works. Yuen, Planning Director Re: Ordinance No. 02 48; Bill No. 177; Effective Date: 04/10/02 Deaz Mr. Yuen, I would like to first thank you and the council members for granting the rezoning of my property TMK# 2-2-22:006 to General Commercial subject to conditions. While I have been in touch with contractors to construct my back office so that I am in compliance with ADA regulations, it has. been a long process, and everyone seems extremely busy. As a result, construction has not yet started, and I am therefore requesting an extension of time be granted until April 10, 2006 for this project to be completed. But, I am hoping to have it completed no later than December 31, 2004. I thank you in advance for your consideration of my situation, and look forward to a favorable reply.
