The subject property is approximately 1.618 acres in size and split zoned with RM-4 (32,762 square feet) and Open (37,718 square feet) zoning designations. Your request is to adjust the zoning boundaries by increasing the RM-4 zoned area and decreasing the Open zoned area of the subject property to accommodate portions of the eaves and lanai for the proposed dwelling to be constructed. A previous Archaeological Preservation Plan in 1999 originally identified a preservation site on the subject property that is within close proximity to a section proposed to be rezoned from Open to RM-4. However, by letter dated November 1, 2002, the Department of Land and Natural Resources acknowledged the findings in a more recent report, Archaeological Survey and Subsurface Testing of SJHP Site 21229, Lot 2, 49 Black Sands Subdivision, by Robert B. Rechtman Ph.D., October 2002, that the previously designated preservation area were natural features created by the uplift of the kiawe tree roots rather than a cultural reserve. Thereby, allowing the preservation buffer to be moved makai and reestablished at the shoreline setback line. Comm. No.__ I~__ Ref. To; Ref. Uale~--~- David Stringer Architects LLC AIA Page 2 January 27, 2004 The new metes and bounds description accommodates the structural design of the dwelling by adjusting the district boundaries only where needed (roof eaves and lanai intrusion), thereby, increasing the RM-4 zoned area in four (4) separate sections with a total of 668 square feet or approximately 2% of the existing RM-4 zoned area. Specifically, the following are the breakdowns of the 4 azeas and square footages involved: Area 1 79 square feet Area 2 21 square feet Area 3 316 square feet Area 4 252 square feet With the non-significant zone change, the total RM-4 zoned area will be approximately 33,430 squaze feet and the Open zoned area approximately 37,050 squaze feet. According to Section 25-2-45 of the Zoning Code regarding Non-Significant Zoning Changes, the Planning Director may administratively grant non-significant zoning changes that must comply with the designations for the property set forth in the general plan and any development plan adopted by ordinance, and must either: (1) Not result in a net increase in the density allowed in the zoning district(s) containing the affected area; or (2) Be the lesser of a five percent or one acre increase or decrease in the azea of any zoning district(s). Upon review of the request, we have determined that your request complies with the criteria set forth in Section 25-2-45(x)(2) of Chapter 25, Hawaii County Code, for determining non-significant zoning changes. 1) The adjustment of zoning boundaries will not result in any increase in the zoning densities. 2) The area under review is in compliance with the General Plan. The project site is situated within an area designated as Resort and Open by the General Plan Land Use Pattern Allocation Guide (LUPAG) map. The area of the RM-4 zoning district will increase in size by 668 square feet or 2%, which is less than 5% of the RM-4 zoning district area. In developing the Kenandy plan, and in order to create a varying depth from the shore line rather than simply building along the open zone boundary line, we have chosen to serrate or set back, at an angle, the building facing tionoka'opa Bay. In researching the original recorded Open Zone boundary line, there was thought to be an historical archeological site deep into the corner of lot 2. That site has now been vacated by the State; Department of Land & Natural Resources (see exhibit 2). It was our understanding that the Open Zone was placed on the property to protect the vista of that purported archeological site, as well as others located at the shoreline. With the absence of that vacated site we are asking for a zoning boundary adjustment of ten feet to the north and east in order to accommodate the roof overhang projections along that property line. This area represents less the five percent of the Lot 2 area. The owners wish to have the home meld into the landscaping is reinforced by the fact that she will be using less then fifteen percent of the site area in building coverage. It is our understanding under the provisions of Rule 8, up to five percent of lot area would be considered anon-significant change, and that this change can be administratively approved. Our calculations indicate that five percent of lot area would translate to an eleven foot adjustment on the north and east boundary lines. The report was prepared for Kenandy, LLC of Menlo Park, California. The purpose of the wrrent survey was to re-assess the nature, significance, and proposed treatment of Site 21229 (a habitation site), which was initially recorded in 1975 as Bishop Muscum Site 50.Ha-E1-404. The site was recorded in more detail by Ogden Environmental and Energy Services in 1996. In the current survey particular attention was paid to Features 1 and 2, which had ban previously interpreted as possible burial markers or ritual features and used in the evaluation of the site as significant under Criterion "e." Features 1 and 2 were remapped during the current project and test excavations were undertaken at Feature 2. No cultural material was recovered in the excavation. The results of your work suggest that Features 1 and 2 are natural features created by the uplift of kiawe tree roots. U view of the new evidence gathered concerning Features 1 and Z, Site 21229 has been reevaluated as significant for its information content only (Criterion "d"). We concur with this reevaluation. You have recommended that Site 21229 be preserved ~`as is" and that the preservation buffer be reestablished to coincide with the shoreline building setback as shown on Figure 3. This would exclude the two natural "features" from the preserve area. It is our understanding that the rest of the approved preservation plan for this site remains unchanged.
