RESOLUTION CREATING TWO (2) DEPUTY PROSECUTING ATTORNEY
(TEMPORARY) POSITIONS FOR THE OFFICE OF THE PROSECUTING
ATTORNEY
WHEREAS, the Office of the Prosecuting Attorney is a recipient of an U.S. Department of
Justice's Community Oriented Policing Services (COPS) grant award, which is passed through the
Hawaii Community Foundation (HCF) as part of the Big Island Meth Initiative; and
WHEREAS, these grant funds will provide for the establishment of two (2) Deputy Prosecuting
Attorney (Temporary) positions, one in East Hawaii and one in West Hawaii, for the purpose of
working with County, State, and Federal law enforcement officials in prosecuting individuals and
organizations distributing large quantities of ice and other drugs; and
WHEREAS, the creation of these positions will complement the dedication of the Police
Department's efforts in their enforcement strategy by providing swift prosecution services with regard
to review of warrants, charging decisions, preliminary hearings, grand jury, trial and appeals; and
WHEREAS, these deputy prosecutor positions are also designated to be appointed as special
assistant U.S. Attorneys and will participate in the referral and/or trial of defendants in the Federal
District Court; and
WHEREAS, Article V, Section 5-1.3(c) of the Hawaii County Charter states that the Mayor has
the power to "Create positions...fortyhich appropriations have been made by the council...".
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII
that two (2) Deputy Prosecuting Attorney (Temporary) positions be created for as long as there are
grants or other outside source of funds available.
'~E IT FU~TFI~I? RESOLVED that a copy of this resolution be transmitted to the Departments
of Finance and Civil Service and to the Office of the Prosecuting Attorney.
