HomeMy WebLinkAboutRES 157 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 157 04 A RESOLUTION RELATING TO A COUNCIL INITIATED IMPROVEMENT DISTRICT IMPLEMENTATION STUDY FOR THE CONSTRUCTION OF CERTAIN WASTEWATER AND SEWER SYSTEM IMPROVEMENTS FOR WAIAKEA, DISTRICT OF SOUTH HILO, HAWAII WHEREAS, the Council of the County of Hawai `i wishes to initiate proposed improvements on certain real property located at Waiakea, District of South Hilo, County and State of Hawaii for improvements consisting of an extension to the municipal sewer system, pursuant to the provisions of Section 12-10, Hawaii County Code, as amended; and WHEREAS, the US Environmental Protection Agency (EPA) has promulgated Underground Injection Control regulations on December 7, 1999 which require that large capacity cesspools existing prior to that date must be upgraded or closed by April 5, 2005; and WHEREAS, the operative "sewer policies" referenced in Ordinance 89-142, An Ordinance Adopting the County of Hawaii General Plan and Repealing Ordinance No. 439, As Amended ("the General Plan") for the general planning of sewerage disposal systems are decades old, to wit: the "Sewerage Study for All Urban and Urbanizing Areas of the County of Hawaii, State of Hawai`i," December 1970, the "Water Quality Management Plan for the County of Hawai`i," December 1980; and WHEREAS, the "Sewer Policies" outlined in the General Plan states, in part: • "Private systems shall be installed by land developers for major resort and other developments along shorelines and sensitive higher inland areas, except where connection to nearby treatment facilities is feasible and compatible with the County's long-range plans, and in conformance with state and county requirements; • The County shall take immediate steps to designate treatment plant sites, sewerage pump station sites, and sewer easements according to the facility plans to facilitate their acquisition; • The County shall seek State and Federal funds to assist in financing the construction ofproposed sewer systems;" and WHEREAS, the General Plan states that one course of action necessary to promote the policies of the County for the South Hilo District is to "Expand the existing sewer collection system to include interceptors and pump stations;" and WHEREAS, in its assessment of the projected sewage flow capacity of the Hilo Wastewater Treatment Plant, the "Hilo District Facilities Plan Amendment" prepared for the County of Hawaii Department of Public Works dated February 1989 identified the Kinoole Street Sewer including the area surrounding the KTA Shopping Center and the Puainako Towne Center as a priority for funding and implementation; and WHEREAS, the owners of the KTA Shopping Center and the Puainako Towne Center have requested the assistance of the County in their efforts to comply with the EPA regulation and connect to the County sewer system; and WHEREAS, the Council of the County of Hawaii acknowledges the need to implement improvements consisting of an extension to the municipal sewer system on certain real property located at Waiakea, District of South Hilo, County and State of Hawaii; and WHEREAS, extension of said improvements from the existing Hilo Wastewater Treatment Plant will include, but not be limited to, necessary gravity sewers, manholes, pump station(s) and force mains, and sewer laterals with deanouts to be installed to each property serviced by the proposed improvements; and WHEREAS, the Council acknowledges that there are a number of public and private developments planned or completed in this region including, but not limited to, Home Depot, KTA Shopping Center, Puainako Towne Center, Ginger Patch Shopping Center, and various public landowners including the County of Hawaii Department of Public Works Baseyard, The County of Hawaii Department of Parks and Recreation, the State of Hawaii Department of Land and Natural Resources, the State of Hawai `i Department of Hawaiian Homelands, as well as the proposed mauka expansion of the University of Hawai `i at Hilo to accommodate the proposed Pacific Basic Agricultural Research Center; and WHEREAS, the Council acknowledges that the mix of private and public development of properties within the region requires the preparation of a comprehensive regional plan of wastewater treatment needs and sewer; and WHEREAS, the Council finds that a number of options may be chosen for the allocation of costs of sewer system improvements, including, but not limited to: distribution of sewer improvement district costs by parcel, allocation by zoning or permissible number of units assigned to each parcel, potential usage, required sewer capacity, square footage of buildings, benefits conferred upon the land, or a combination thereof; and WHEREAS, the allocation of costs associated with said improvements and the preferred financing thereof may best be determined after the scope and timetable(s) of intended development, including incremental development, of all affected landowners are surveyed, and all landowners are consulted within a regional planning process. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF NAWAI`I that: (1) in consultation with the landowners referenced above, the Director of the Environmental Management is directed to prepare for submission to the Council (a) a broad regional sewerage master plan for the Waiakea region north of South Hilo, and (b) a specific and detailed implementation plan for an improvement district to include the necessity, feasibility, proposed boundaries, proposed real properties subject to assessment, estimated total cost, and method of financing desirable for the aforementioned sewer system; and (2) include in the specific and detailed implementation plan all such data, survey, maps, plans, drawings, details and specifications for the improvements and any other matters or details intended to apply thereto in accordance with the provisions of Section 12-10, Hawaii County Code, as amended; and (3) advise the Council as to the preferred method of financing said improvements, whether by Council-initiated improvement district, owner-initiated improvement district, tax increment district, or private financing.
