RE: Request to Waive Consideration of the Nomination of Hawaii County Council Member
Aaron Chung and Kauai County Council Member JoAnn Yukimura as the Hawaii State
Association of Counties (HSAC) Representatives on the Board of Advisors of the Center
for Alternative Dispute Resolution
Pursuant to Section 1(g) of Rule 4 of the Procedure of the Council of the County of Hawaii, 1
request your support for waiver of this matter from my Committee on Public Works and
Intergovernmental Relations for consideration and approval by the full Council at its next
scheduled meeting on March 5, 2004.
Enclosed is a letter dated October I5, 2003 from Elizabeth Kent, Director, Center for Alternative
Dispute Resolution to Dain P. Kane, President, HSAC, requesting HSAC support for the
nomination of Council Member Aaron Chung and Kauai County Council Member JoAnn
Yukimura as the HSAC representatives on the Board of Advisors of the Center for Alternative
Dispute Resolution. The HSAC Executive Committee has requested that the positions of each of
the counties on the nominations be reported by February 27, 2004. Action requested:
Nomination of Council Member Aaron Chung and Kauai County Council Member JoAnn
Yukimura as the HSAC representatives on the Board of Advisors of the Center for
Alternative Dispute Resolution.
Action to nominate of Council Member Aaron Chung and Kauai County Council Member JoAnn
Yukimura as the HSAC representatives on the Board of Advisors of the Center for Alternative
Dispute Resolution is advisable as HSAC will be reviewing the nominations in late February or
soon thereafter, so timely approval is crucial. It is therefore advantageous that approval is
granted for these matters to be placed onto the next Council agenda for review. However, in the
event this request is denied, for whatever reason, I understand the matter shall be referred to the
Committee on Public Works and Intergovernmental Relations for placement on its future agenda.

Re: Appointment of Councilmember Aaron Chung and Councilmember JoAnn Yukimura to
the Board of Advisors for the Hawaii State Judiciary's Center for Alternative Dispute
Resolution
Dear Councilmember Kane:
In 1985, the Hawaii State Judiciary created the Program on Alternative Dispute Resolution. In
1989, with the passage of Act 346 (Hawaii Revised Statutes, Section 613), the Center for
Alternative Dispute Resolution (Center) was established.
Chapter 613-3, Hawaii Revised Statutes, states that the Center shall have a Board of Advisors,
and that it shall include two representatives from the Hawaii State Association of Counties
(HSAC). There aze presently two vacancies on the Center's Board, and we respectfully request
that those vacancies be filled by Councilmember Aaron Chung (County of Hawaii) and
Councilmember ]oAnn Yukimura (County of Kauai), I spoke to both councilmembers about the
Center's Board of Advisors, and they indicated their interest and willingness to serve. We
believe that they would be wonderful additions to our Board and hope that the HSAC will
support the appointments,
Please contact me if you have any questions about this request. I will be happy to provide you
with information that will assist HSAC in making a positive decision on this request. Also,
enclosed with this letter you will find some materials that describe the Center, mediation
programs and other alternative dispute resolution programs. We will be happy to provide you
with additional copies of these educational materials.
