12E: Proposed Charter Amendment -Legislative Auditor

The purpose of this letter is transmit a bill for an ordinance proposing an amendment of
the Hawaii County Charter.
The intent of the proposal is to create an independent Office of the Legislative Auditor in
order to improve County government efficiency, effectiveness and integrity. Presently, the
Legislative Auditor is appointed by the County Clerk, who is appointed by a majority of the
County Council. Any change in Council majority, even mid-term, could, as it has in the past,
result in removal of the Legislative Auditor. Under the proposed amendment, the Auditor would
be appointed by the County Council for an eight year term and could only be removed for cause.
Also, the powers of the Legislative Auditor would be augmented and the office's role more
clearly defined.
