We have reviewed the submitted photos and Kohala Ranch Park Plan and find that it meets the requirement of Condition K. As a side note, if it is your intention to dedicate the park to the County in the future, all ADA requirements and improvements must be met and completed before this matter would be considered. Yuen, Director County of Hawaii Planning Department 101 Pauahi Street, Suite 3 Hilo, Hawaii 96720 Dear Mr. Yuen: Subject: Kohala Ranch Project IV Change of Zone Ordinance No. 92-40 Compliance with Condition (K) Kahua and Waika, North Kohala, Hawaii Island The Kohala Ranch Project IV development area, consisting of approximately 1,288 acres, was reclassified from the State Land Use Agricultural District to the State Land Use Urban District on November 10, 1988. Ordinance No. 92-40 subsequently amended the zoning district classification from Agriculture (A -20a) to Single Family Residential (RS -20), Village Commercial (CV -10), Multiple Family Residential (RM -4) and Open. A total of 1,490 residential units is allowed under the existing zoning. Ordinance No. 92-40 contains numerous conditions of rezoning, including Condition K, which requires the development of an active park within the Project Area as part of the initial phase of development. Condition K of Ordinance No. 92-40 states: The applicant shall set aside a minimum of 5 acres of land within the project site for active park and recreational uses. The active park site shall be improved by grading and grassing in conjunction with final subdivision approval of any residential subdivision and shall remain in private ownership. The park development, maintenance and operational plan shall be submitted for review and approval by the Planning Department, in consultation with the Department of Parks and Recreation; The Kohala Ranch, LLC is proposing to provide this park on the site of the former polo field that was developed in the late 1980s. Polo activities were abandoned in the 1990s and in early 2002, Kohala Ranch, LLC grassed the former polo field for use as a possible park. The existing improvements include grass and gravel parking areas, restroom facilities, grassed play field and other grassed areas for active and passive use. Photos of the proposed park site are attached as Exhibits A through 1. Photos A and 13 show the grassed playing field from a perspective looking makai from the grandstand area. Photo E shows the gravel/cinder parking area and Photos F and G show the overflow grassed parking area south of the grandstand. Photo H depicts the grassed playing field looking North, with a partial view of the grandstand and Photo I shows the lawn north of the grandstand. In accordance with Condition K of Ordinance No. 92-40, please find attached the Kohala Ranch Park Plan for your review and approval. Upon approval of the Kohala Ranch Park Plan and confirmation that the existing park improvements comply with the requirements of Condition K, Kohala Ranch, LLC will immediately implement the Park Plan. The park development, maintenance and operational plan shall be submitted for review and approval by the Planning Department, in consultation with the Department of Parks and Recreation; Kohala Ranch Park Plan Location and Configuration The Kohala Ranch Park is proposed to be provided on the site of the former polo field that was developed in the late 1980's. This site was originally improved with a cider polo field, restroom facility and grandstand. The polo activities were abandoned in the 1990's. In early 2002, Kohala Ranch LLC, grassed the former polo field for use as a possible park. The park facilities include grass and gravel parking areas, restroom facilities, grassed play field and other grassed areas for passive and active use. The park plan and location map within Kohala Ranch are provided as Figure No. 1. As Kohala Ranch matures, the location of the Kohala Ranch Park may change. If so, Kohala Ranch, LLC or its successors are committed to providing similar improvements, including grassed play field and parking areas prior to the closing of the existing park improvements. Kohala Ranch Park Plan January 2, 2004 Page No. I Timing Upon approval of the Plan Approval application, the Kohala Ranch Park will be open and available for use as the improvements have already been provided. Conditions The Kohala Ranch Park will be privately owned and maintained. It will be available for use by residents and guests of the Project IV development area. The park will be available to Kohala Ranch Project I -III residents and guests on a space available basis. Hours of Operation The Kohala Ranch Park will be open during daylight hours. Portions of the park may be open during evenings for special events. Improvements The Kohala Ranch park is already improved with a grassed play field, restroom facilities, grandstand, and grassed and gravel/cinder parking areas. Maintenance The park will be owned and maintained by Kohala Ranch, LLC. As the Kohala Ranch Project IV area develops, the ownership and maintenance responsibility of the Ranch will be transferred to the Kohala Ranch Project IV Community Association or other entity or assignee. In this event, a covenant or similar legal encumbrance which shall obligate the owners or assigns to maintain the park, recreation or open space areas in perpetuity shall be recorded with the Bureau of Conveyances prior to such transfer.
