RESOLUTION NO. 162 0~
RESOLUTION AUTHORIZING THE MAYOR OR HIS DULY AUTHORIZED
REPRESENTATIVE TO NEGOTIATE AND TO EXECUTE NECESSARY DOCUMENTS
WITH WESTPRO DEVELOPMENT, INC. TO INCREMENTALLY SATISFY
CONDITION "M" OF ORDINANCE N0. 98-66.
WHEREAS, Westpro Development, Inc. (WDI) is the owner of
approximately 17 acres of land at Kalaloa, 4th, North Kona,
Hawaii, covered by tax map key (3) 7-3-10: Portion of 48
(Property); and
WHEREAS, On July 2, 1998, Change of Zone Ordinance
No. 98-66 became effective, changing the zoning from Unplanned
to Single Family Residential (RS-10 and RS-15); Multiple Family
Residential (RM-4), and Neighborhood Commercial (CN-10); and
WHEREAS, Condition "M" of Change of Zone Ordinance
No. 98-66 for the Property requires that the owner comply with
the requirements of Resolution 65, which was superseded by
Chapter 11 of the Hawaii County Code, pursuant to Chapter 11,
Section 8 of the Hawaii County Code; and
WHEREAS, WDI wishes to incrementally satisfy Condition "M"
of Change of Zone Ordinance No. 98-66; and
WHEREAS, County has determined that residents of West
Hawaii have a difficult time finding affordable housing units
to purchase or to rent; and
WHEREAS, pursuant to Chapter 11, Section 11-4(a), (b) and
(c)(2) of the Hawaii County Code, the Hawaii County Housing
Agency has adopted HCHA Resolution No. 135, directing that WDI
incrementally satisfy Condition "M" by producing new affordable
housing.
NOW, THEREFORE, BE IT RESOLVED BY THE HAWAII COUNTY
COUNCIL that, the Mayor or his duly authorized representative is
authorized to negotiate with Westpro Development, Inc. and to
execute necessary documents to incrementally satisfy
Condition "M" of Ordinance No. 98-66.
BE IT FURTHER RESOLVED, that a copy of this resolution be
transmitted to Westpro Development, Inc., the Office of Housing
and Community Development and the Planning Department.
BE IT FURTHER RESOLVED, that this resolution shall take
effect immediately.
