The Planning Commission recommended favorably the above mentioned
applications to the County Council on May 1, 1997. we understand,
as mentioned in the Commission's letter to the Council dated May
20, 1997, that the Complete background Information by staii and
the recommendation by the Hlanntng Director, has been receaved~by
tk,e Council for further review in Committee.
As we concur with the staff and Commission, we refer to back-
ground inYarwatiou in order to avoid repetitions.
we request respectfully that conditions D., F „ H, and I. be amen-
ded with the Cuur,c:il's permission.
Under the usual circumstances the conditions would be completely
"rectifier as written. However, iu Lhis case, where the development
and improvements are already completed and 1n place, some amendment
of the worcliny appears to be proper and in order. ~.7
In the case of condition D „ underground utilities, a rephrase of
the last benLeuce would appear proper In the applicant's opinion. ~ y
The entire road between Kona Yalrsades and Coastview reflects the N c
typical H~LCO Overhead installation, and the applicant would not Z °i
have any Influence on a change from overhead to undergrounfl. The d N

of the Engineering uivision in Kona, Tom Yack suggested that under )G ~

the change from overhead to underground would come ir.`.o effect.
However appiicar~L is aware that the purpose o£ thie _ondition
is mainly to assure that applicant's fair share in the Lotal
costs of underground utilities in such case could be properly
imposed.
Conditions P',H,I are somewhat related. all improvements are in
place, and applicant has no problem with the conditions that will
not permit additional Ohana units / dwAllings. However, applicant
believes, since there are no added units possible, that the fair
share contribution "based on a maximum density for each lot", as
listed in condition H., would then be some kind of double jeopardy,
in view of condition F pertaining to ohanas.
Based on the aiuregaing reasons applicant and consultant requPSt
respectfully a clarification and approval of the applications.
Sincerely,
Klaus D. puventz
