Pax (808)961 -824R February 23, 2004 Honorable James Arakaki, Chairperson and Members of the County Council Hawaii County Council 25 Aupuni Street Hilo, Hawaii 96720 Re: Resolution to Amend Resolution No. 37-03, Multi-year lease for office space for the Kona Driver License Section On February 20, 2004, the County Council adopted Resolution No. 37-03 that authorized the payment of funds of a later fiscal year and more than one fiscal year for the multi-year lease of office space for the Hawaii County Police Department's Kona Driver License Section at 75-5722 Hanama Place, Kailua-Kona. Since that time, the needed office space to properly accommodate the functions of that office has increased by 622 square feet bringing the total lease space to 2,622 square feet and the property owners have acquired another realtor to administer this lease. Enclosed is a resolution amending Resolution No. 37-03 by increasing the square footage of office space and the monthly lease amount and mentioning the new realtor's name in the Kona Driver License Section's multi-year lease. In order to expedite the implementation of this lease so that the office space renovations may commence immediately, I would like to request a waiver from the Finance committee and have this bill heard at the next Council meeting scheduled for March 5, 2004. REQUEST: To amend Resolution #37-03 by increasing the square footage of the multi-year lease at 75-5722 Hanama Place. B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): The County Council passed Resolution #37-03 allowing the County of Hawaii to enter into amulti-year lease for the Kona Driver License Section at 75-5722 Hanama Place. At the time the request for space was made, it was estimated that we needed approximately 2,000 square feet for the Kona Driver License Section. After working with the architect on the functions of the Driver License Section in relation to the proposed layour of the office, we determined that the original request was approximately 622 square feet less than it should be. Thus, we are requesting approval to lease approximately 2,622 square rather than 2,000 square feet at the original rent per square foot. SIGNED: ` " DATE: FEB 2 O 2004 Department Head COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 3 ~ U:3 RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND MORE THAN ONE FISCAL YEAR FOR AMULTI-YEAR LEASE OF REAL PROPERTY FOR THE KONA DRIVER LICENSE SECTION WHEREAS, Section 10-11 of the County Charter requires that any contract, lease, or other obligation requiring payment of funds from the appropriations of a later fiscal year and more than one fiscal year be approved by resolution; and WHEREAS, the Hawaii County Police Department's Kona Driver License Section needs to relocate to another facility; and WHEREAS, its present location poses a safety and fire hazard to the employees and to the public; and WHEREAS, the County wishes to enter into a five (5) year lease with Sofos Realty for the 2,000 square feet of office space located at the Kona Center, 75-5722 Hanama Place, Kailua-Kona; at an approximate cost of $4,584 per month. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII: 1. That the Mayor is hereby authorized to enter into amulti-year lease agreement for office space for the Police Department. 2. That sufficient funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the lease agreement. Pursuant to Section 1(g) of Rule 4 of the Rules of Procedure of the Council of the County of Hawaii, this written request is submitted with my approval that the above-referenced matter be waived from the Committee on Finance to the full Council for immediate action. In reviewing this matter, timely approval is crucial [t is therefore advantageous that approval is granted and the matter placed onto the next Council agenda for review.
