As we concur with the staff and Commission, we refer to back- ground inYurwaLion in order to avoid repetitions. we request respectfully that conditions D., F., H. and I, be amen- ded with the Council's permission. Under the usual circumstances the conditions would be completely rectified as written. However, in this case, where the development ' acid improvements are already completed and In place, some amendment; of the wording appears to be proper and in order. In the case of condition D., underground utilities, a rephrase ofd , the last benLence would appear proper in the applicant's opinion.,~„)~` d z~ The entire road between Kona Palisades and Coastvlew reflects the•1iW~,~ m typical H~LCO Overhead installation, and the applicant would not have any influence on a change from overhead to undergrounfl. However applic:a~ll is aware that the purpose of this condition is mainly to assure that applicant's fair share In the Mal costs of underground utilities in such case could be properly imposed. Conditions F,H,I are somewhat related. all improvements are in place, and applicant has no problem with the conditions that will not permit additional Ohana units / dwellings. However, applicant believes, since there are no added units possible, that the fair share contribution "based on a maximum density for each lot", as listed in condition H., would then be some kind of double jeopardy, in view of condition P pertaining to ohanas. Based on the aLuregaing reasons applicant and consultant requeFt respectfully a clarification and approval of the applications.
