A [31LL FOR AN ORDINANCE AMENDING CHAPTER 2 OF TI IE HAWAI`I COUN"PY CODE 1983 (1995
EDITION), ADMINISTRATION, RELATING TO THE ESTAE3LISHMENT OF VOLUNTEER FIRE
STA"PIONS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose. According to section 46-13.1, Hawaii Revised Statutes, the county council
may establish and maintain one or more volunteer fire stations in any area or areas of the county as it may
determine to be necessary to provide adequate fire protection. While some volunteer fire stations may require
monies to be budgeted, others may not For this reason, it is important that the location of all volunteer fire
stations be specified by law in order for the council and the general public to know where these stations would be
sited.
This ordinance will also correct Section 2-17, Hawaii County Codc, Hcad oCvolunteer fire department,
which has inadvertently nnmcd a position that the fire department does not have.
SECTION 2. Chapter 2, Article 6 ofthe Hawaii County Code, 1983 (1995 Edition), relating to
Volunteer Fire Department, is hereby amended, by the addition of a new section to read as follows:
°Section 2-16.1 Volunteer fire stations.
In accordance with provisions of section 46-13.1, Hawaii Revised Statutes_ the following
volunteer fire stations are established in the County of Hawaii to be sited and operated by the head of
the volunteer fire department pursuant to powers granted under this article:
I . Peue`ekeo volunteer fire station.
2. Kulani volunteer fire station.
3. Volcano volunteer fire station.
4. Hawaiian Act'es volunteer fire station.
5. Fern Forest volunteer fire station.
6. <'ern Acres volunteer fire station.
7. Miloli`i volunteer fire station.
8. Kona Paradise volunteer Pire station.
9. Kona V illaee volunteer fire station.
10. Ka`u pulehu voluntccr fire station.
I I . Dour Seasons volunteer fire station.
12. Pa`auilo volunteer fire station.
13. Waiki`i volunteer fire station.
14. Hawaiian [3eaches volunteertlre station.
15. Wa'awa`a volunteer lire station.
I G. Na`alehu volunteer fire station.
17. Hawaiian Ocean View Estate volunteer fire station.
18. Discovery Harbor volunteer tine station.
19. P5hala voluntccr fire station.
20. North Kohala Coast volunteer fire station.

SECTION 3. Chapter 2, Article 6 of the Hawaii County Code, 1983 (1995 Edition), relating to
Volunteer Fire Department is hereby amended.
"Section2-17. Head of volunteer fire department.
(a) The [ '~~ar] fire chief of the County fire department shall be the head of the volunteer
fire department. The head of the volunteer fire department shall:
(1) Be vested with the management and control of the affairs, personnel, and property of the
department, subject to the general authority and control of the council.
(2) With the consent and approval of the council, make expenditures of moneys
appropriated by the council for the department
(3) Not contract any debt on behalf of the department not dispose of any property
belonging to the department without the consent of the council;
(4) Make periodic reports to the council concerning the affairs and activities of the
department; and
(5) Perform and discharge such other duties as may be assigned to him by the council."
SECTION 4. Material to be repealed is bracketed. New material is underscored. In printing this
ordinance, the bracketed material need not be included.
SECTION 5. If any provision of this ordinance, or the application thereof to any person or
circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance
which can be given effect without the invalid provision or application, and to this end the provisions of this
ordinance are severable.
SECTION 6. This ordinance shall take effect upon its approval.
