COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION N0.1~9 0~~ <br /> RESOLUTION AUTHORIZING A GRANT OF EASEMENT FOR RETAINING WALL <br /> PURPOSES AT KONA HEIGHTS SUBDIVISION, INCREMENT II, FP 1077, <br /> HIENALOLI 5th & 6th, NORTH KONA, ISLAND, COUNTY AND STATE OF HAWAII, <br /> <br /> TAX MAP KEY: (3) 7-5-29: PORTION OF ALOHA KONA DRIVE AND NELE PLACE, <br /> <br /> TO MS. BETH ANN FRYE <br /> WHEREAS, the County of Hawaii is the owner of that certain roadway parcel located in the <br /> Kona Heights Subdivision Increment II, at Hienaloli, North Kona, Island, County and State of Hawaii, <br /> known as Aloha Kona Drive and Nele Place; and <br /> WHEREAS, Ms. Beth Ann Frye, is the owner of lot 108 of the Kona Heights Subdivision <br /> Increment II, at Hienaloli ,North Kona, Island, County and State of Hawaii, specifically identified as <br /> Tax Map Key (3) 7-5-29:53; and <br /> WHEREAS, the retaining wall owned by Ms. Beth Ann Frye along the northeasterly boundary <br /> of the Aloha Kona Drive and Nele Place intersection encroaches into the public right-of-way; and <br /> WHEREAS, Ms. Beth Ann Frye needs the grant of easement to maintain its retaining wall <br /> along the northeasterly boundary of the Aloha Kona Drive and Nele Place intersection within the <br /> public right-of-way; and <br /> WHEREAS, the required easement is approximately 29 square feet and is appraised at <br /> $572.OO;and <br /> WHEREAS, Section 2-111 of the Hawaii County Code authorizes the Council, by resolution <br /> approved by a majority, to direct the finance director to grant easements from the County of Hawaii, <br /> subject, however, to reversion to the County of Hawaii upon termination or abandonment of the <br /> easements for the specific purposes for which it was granted. <br /> <br />
