Box 2156 Kailua-Kona, Hawaii 96745 TESTIMONY Re: STATE LAND USE BOUNDARY AMENDMENT APPLICATION (SLU 03-007) REQUEST: AGRICULTURAL TO URBAN CHANGE OF ZONE APPLICATION REQUEST: AGRICULTURE TO SINGLE FAMILY RESIDENTIAL APPLICANT NANI KONA AINA, LLC TAX MAP KEY: (3) 7-5-010:066 Please accept this as my written testimony concerning the above. I have provided extensive written documentation and testimony to the County Council's ' Planning Committee and Planning commission, including maps and deeds, concerning the above matter, which I am incorporating by reference, and which I urge you to review. A brief synopsis of this prior communication is as follows: 1. The applicant's submittal does not show and acknowledge that the entrance to its proposed development will create afour-way intersection on the Heinaloli-Kahalui substandazd road, with Keaolani Drive. Keaolani Drive connects mauka with Mamalahoa Highway, [hough gated Keaolani subdivision. 2. The applicant's principals control several other parcels of land intended for development that would utilize the same overburdened infrastructure (Nani Kailua Drive) its present application intends to use. 3. The applicant's principals control other land intended for development that would allow j it to provide access to Kuakini Highway without adding to the overburden infrastructure it prefers to use as a less expensive alternative. 3- 3-04; 10: 04AM: Ven P2rnis. ;809 329695 # 4/ 6 4. Nana Kailua Drivewas designed and intended for the Kailua View Estates Subdivision only, and the Aloha Kona subdivision traffic was redirected onto Nana Kailua when its access to Kuakini Highway and Hualalai Road was blocked by State improvements to Kuakini Highway. This doubled the intended and planned traffic on Nani Kailua and overburdened it. 5. Keaolani subdivision and other development along the Hienaloli-Kahului Road (the old railroad) have also added to the overburdened Nani Kailua. The County must stop adding more traffic to Nato Kailua as the applicant wants to do for private gain at public expense. It was publicly reported that Planning Duector Yuen stated that Nani Kailua is one of the best streets in Kona directing traffic onto Kuakini Highway. While this may be i<-ue, that is a comment on the inadequacy of other streets, not an approval of Nani Kailua as any kind of a street that can take the additional traffic the applicant wants to put there. I point out the following uncontradicted facts: 1. Nani Kailua is not an urban street with the infrastructure urban streets require, i.e. no curbs, gutters, sidewalks, pazking, or school bus facilities; 2. The applicant purposes an urban use, but no urban street facilities on Heinaloli-Kahului Road from the applicants proposed urban subdivision to Nani Kailua, i.e. no four way intersection at its entrance, no curbs, gutters, sidewalks, pazking, or school bus facilities. 2 Mazk & Kristi Van Pemis - P. If the County can't pay and provide for infrastructure concurrently with development, by general revenue or special taxation districts, then it must require private developers, who will have their land massively increased in value immediately upon the gift of the County grant of rezoning, to timely create the offsite infrastructure. Until that infrastructure is in place, development must be delayed. There is no doubt that public infrastructure in West Hawaii lags faz behind perntitted private development. There are ten of thousands of units and lots and subdivisions already zoned by the County, but unbuilt. There are millions of dollars of public infrastructure the County desperately needs that private developers who received the benefits of the County approvals and rezones must provide, but haven't, because the County has granted the requested delays in development while developers profitably sold and resold their approved and regained properties during those delays. It is time for the County to say "no" to more rezoning unless the urban offsite infrastructure is concurrently in place: A rezoning moratorium. This will promote the development of the tens of thousands of units already improved, catch up on infrastructure and make West Hawaii a better and more livable place. More units and more infrastructures for the growing population will be produced, and the local economy made healthier. Maui is an example. Its rezoning moratorium produced what was reported at the strongest economy in the State, propelling its Mayor Lingle to the Governmanship. Your job is to serve the people, first. This application must be subservient to that priority. The Planning Commission recommended against this application---serving the people here means making sure there is adequate urban infrastructures offsite as well as on site: anew acce« to Kuakini, curbs, gutters, sidewalks, a four way intersection, bus facilities, on site and offsite to Kuakini. Or turn the application down until that infrash~ucture exists. 3 Mark & Kristi Van Pernis - P. O.
