Arakaki, Council Chair And Council Members Hawaii County Council 25 Aupuni Street Hilo, HI 96720 SUBJECT: DRAFT ORDINANCE AMENDING CHAPTER 21 OF THE HAWAII COUNTY CODE RELATING TO THE DELETION OF SEWER CONNECTION EXCEPTIONS Forwarded for your review and consideration is a draft ordinance that amends Chapter 21 by deleting provisions that allow exceptions to the connection requirements for lots accessible to a sewer. The ordinance does establish a process for requesting avariance/exemption to the connection requirements. The purpose of this ordinance is to bring the County into compliance with Section 11-62-06(b), Hawaii Administrative Rules (HAR) that states "All building(s) generating wastewater and located within or near proximity of an available public sewer system as determined by the director [of health], shall connect to the public sewer." The Environmental Management Commission, at its May 22, 2002 meeting, had also recommended approval of this ordinance. Mayor Kim approved this amendment to Chapter 21 on July 2, 2002.
