RESOLUTION AUTHORIZING A GRANT OF EASEMENT FOR RETAINING WALL
PURPOSES AT KONA HEIGHTS SUBDIVISION, INCREMENT II, FP 1077,
HIENALOLI 5th ~ 6th, NORTH KONA, ISLAND, COUNTY AND STATE OF HAWAII,
TAX MAP KEY: (3) 7-5-29: PORTION OF ALOHA KONA DRIVE AND NELE PLACE,
TO MS. BETH ANN FRYE
WHEREAS, the County of Hawaii is the owner of that certain roadway parcel located in the
Kona Heights Subdivision Increment II, at Hienaloli, North Kona, Island, County and State of Hawaii,
known as Aloha Kona Drive and Nele Place; and
WHEREAS, Ms. Beth Ann Frye, is the owner of lot 108 of the Kona Heights Subdivision
Increment II, at Hienaloli ,North Kona, Island, County and State of Hawaii, specifically identified as
Tax Map Key (3) 7-5-29:53; and
WHEREAS, the retaining wall owned by Ms. Beth Ann Frye along the northeasterly boundary
of the Aloha Kona Drive and Nele Place intersection encroaches into the public right-of-way; and
WHEREAS, Ms. Beth Ann Frye needs the grant of easement to maintain her retaining wall
along the northeasterly boundary of the Aloha Kona Drive and Nele Place intersection within the
public right-of-way; and
WHEREAS, the required easement is approximately 29 square feet and is appraised at
$572.OO;and
WHEREAS, Section 2-111 of the Hawaii County Code authorizes the Council, by resolution
approved by a majority, to direct the finance director to grant easements from the County of Hawaii,
subject, however, to reversion to the County of Hawaii upon termination or abandonment of the
easements for the specific purposes for which it was granted.
NOW, TFIEFt~FORE, CIE IT R~SOLV~® BY TOTE COUNCIL OF THE COU TY OF HAWAII,
in accordance with Section 2-111 of the Hawaii County Code, that it hereby autho izes the director of
finance to grant an easement for the encroachment of said retaining wall to Ms. Be h Ann Frye, her
successors and assigns, as described and delineated on Exhibit "A" attached here o, subject to
reversion upon termination or abandonment of that specific purpose, or upon reco struction of the
retaining wall.

PROPOSED WALL EASEMENT
Land situated at Hienaloli 6th, North Kona, Island and County of Hawaii, State of Hawaii
and being a portion of the Nele Place right-of-way, Kona Heights Subdivision, Increment II.
Beginning at the Southwesterly Aloha Kona Drive curve point of this parcel of land, the
coordinates of said point of beginning referred to Government Survey Triangulation
Station "KAILUA (NORTH MERIDIAN)" being 751.55 feet South and 8,898.93 feet East
and running by azimuths measured clockwise from True South, following along the
remainder of Nele Place right-of-way on anon-tangent curve to the right with a radius of
28.00 feet, the radial azimuth being 158° 34' 44", and the chord azimuth and distance
being;
1. 117° 50' 00" 42.43 feet to a point;
Thence following along Lot 108 on a curve to the left with a radius of 30.00 feet, the
chord azimuth and distance being;
2. 297° 50' 00" 42.43 feet to the point of beginning and containing an
area of 29 square feet.
