RESOLUTION AUTHORIZING THE ACCEPTANCE OF A DONATION OF REAL PROPERTY FROM
SURETY KOHALA CORPORATION; TAX MAP KEY NO. (3) 5-4-009:001 (POR.)
WHEREAS, Surety Kohala Corporation, a Hawaii corporation, is the owner of real property in
Honopueo, North Kohala, Hawaii, specifically Tax Map Key No. (3) 5-4-009:001 (por.); consisting of
approximately 8,000 square feet, being more particularly described in Exhibit "A" attached hereto; and
WHEREAS, this property is an addition to Parcel A (Kamehameha Park addition); and
WHEREAS, Surety Kohala Corporation has graciously agreed to donate this property to the County of
Hawaii as evidenced in the deed attached hereto as Exhibit "B"; and
WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the Council, on
behalf of the County of Hawaii, may accepts gifts or donations of real property.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that
in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, the County of Hawaii accepts
the donation of real property, identified as Tax Map Key No. (3) 5-4-009:001 (por.), consisting of
approximately 8,000 squaze feet, from Surety Kohala Corporation.
BE IT FURTHER RESOLVED that a letter of appreciation be sent to Surety Kohala Corporation.
BE IT FURTHER RESOLVED that a copy of this resolution be forwarded to (1) S ety Kohala
Corporation, P. O. Box 249, Hawi, Hawaii 96719; (2) Patricia G. Engelhard, Director of P ks and Recreation;
(3) Bruce McClure, Director of Public Works; (4) William Takaba, Director of Finance; d

DESCRIPTION
ADDITION TO PARCEL "A" (KAMEHAMEHA PARK ADDITION)
Being a Portion of Grant 1554 to Hoohua
at Honopueo, North Kohala, Island of Hawaii, Hawaii
Beginning at the southeast corner of this parcel of land, on the north boundary
of Parcel "A" (Kamehameha Park Addition), at a point bearing 95° 30' and 180.00 feet
from the northeast comer of Parcel "A" (Kamehameha Park Addition), the coordinates
of said point of beginning referred to Government Survey Triangulation Station "PUU
KAPU", being 5.01 feet North and 796.73 feet West and running by azimuths
measured clockwise from True South:
1. 95° 30' 100.00 feet along Parcel "A" (Kamehameha Park
addition);
2. 185° 30' 80.00 feet along the remainder of Grant 1554 to
Hoohua;
3. 275° 30' 100.00 feet along the remainder of Grant 1554 to
Hoohua;
4. 5° 30' 80.00 feet along the remainder of Grant 1554 to
Hoohua to the point of beginning and
containing an area of 8,000 square feet.

DEDICATION DEED
THIS DEDICATION DEED, made this ~ day of ~'l , 2003, by
SURETY KOHALA CORPORATION, a Hawaii Corporation, whose post office and mailing
address is P.O. Box 249, Hawi, Hawaii 96719, hereinafter called the "Grantor," and the
COUNTY OF HAWAII, a municipal corporation, whose principal place of business and mailing
address is ~5 Aupuni Street, Hilo, Hawai 96720, hereinafter called the "Grantee."
/ WITNESSETH:
That in consideration of the sum of ONE DOLLAR ($1.00) and other valuable
consideration paid by the Grantee, the receipt of which is hereby acknowledged, the Grantor does

hereby grant, bargain, sell, dedicate, and convey unto the Grantee, its successors and assigns
forever, in fee simple, all of that certain real property designated as:
"Addition to Pazcel "A" (Kamehameha Park Addition), being a
portion of Grant 1554 to Hoohua at Honopueo, North Kohala, Island of
Hawaii, Hawaii, containing an area of 8,000 squaze feet, more
particularly described in EXHIBIT "A," attached hereto and made a part
hereof, and, consolidation with Parcel "A" into Parcel "A-1," being
portions of Grant 1547 to J.W. Naihe, Grant 1554 to Hoohua, and L.C.
Aw. 8097, R.P. 6724 to Hoohua at Honopueo, North Kohala, Island of
Hawaii, Hawaii, more particulazly described in EXHIBIT "B," attached
hereto and made a part hereof"
SUBJECT, to the Reservation unto the State of Hawaii of all mineral and metallic mines,
if any.
TOGETHER with the reversions, remainder, rents, issues, and profits thereof and all of
the estate, right, title and interest of the Grantor, both at law and in equity, therein and thereto.
TO HAVE AND TO HOLD the same, together with al] buildings, improvements, rights,
easements, privileges and appurtenances thereon and thereto belonging or appertaining or held
and enjoyed therewith, unto the Grantee, its successors and assigns, for public purposes, forever.
AND, in consideration of the premises, the Grantor does hereby covenant with the
Grantee that the Grantor is seized of the property herein described in fee simple; that said
property is free and clear of and from all liens and encumbrances, except as may herein
specifically be set forth; that the Grantor has good right to sell and convey said property, as
aforesaid; and that the Grantor will WARRANT AND DEFEND the same unto the Grantee
against the lawful claims and demands of all persons, except as aforesaid.
The rights and obligations of the Grantor and the Grantee shall be binding upon and inure
to the benefit of their respective estates, heirs, personal representatives, successors, successors in

trust and assigns. All obligations undertaken by two or more persons shall be deemed to be joint
and several unless a contrary intention shall be clearly expressed elsewhere herein.
The conveyance herein set forth and the warranties of the Grantor concerning the same
aze expressly declared to be in favor of the Grantee, its successors and assigns.
