RESOLUTION NO. 1'72 0~
RESOLUTION AUTHORIZING THE ACQUISITION OF PRIVATE PROPERTIES BY EMINENT
DOMAIN, BEING PORTIONS OF TAX MAP KEYS:(3)2-4-003-022, 2-4-063-120, AND 2-4-063-
121, SITUATE AT WAIAKEA, DISTRICT OF SOUTH HILO, COUNTY AND STATE OF HAWAII,
FOR THE KAWAILANI STREET BRIDGE REPLACEMENT.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
WHEREAS, the County of Hawaii is planning to replace the existing Kawailani Street
Bridge with a new concrete bridge capable of passing the 100 year flood; and
WHEREAS, the proposed replacement of the existing Kawailani Street Bridge will require
the acquisition of portions of Tax Map Key:(3)2-4-003-022, owned by Allan K. Okuda and Kwi N.
Okuda; Tax Map Key:(3)2-4-063-120, owned by Walter S. Murasaki and Edna E. Murasaki; and
Tax Map Key:(3)2-4-063-121, owned by Leigh H. Mizusawa and Sandra M. Mizusawa, delineated
on Exhibit "A" attached hereto, requiring that the County of Hawaii invoke its condemnation
powers in acquiring portions of the private properties to replace the existing Kawailani Street
Bridge; and
WHEREAS, the Council recognizes that the need to replace the bridge is necessary to
prevent future flooding and to address concerns of public health, safety and welfare caused by the
flooding, which constitutes a valid public purpose and use which will benefit the County of Hawaii;
and
WHEREAS, Section 101-13, Hawaii Revised Statutes, requires that a condemnation action
by the County must be authorized by a resolution of the County Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that it is necessary for the public use and purpose, to wit: the improvement, construction,
operation and maintenance of the Waiakea Stream and adjacent land for flood control purposes in
connection with the Kawailani Street Bridge Improvement Project, situate at Waiakea, District of
South Hilo. County and State of Hawaii, to take, acquire and condemn portions of those certain
private properties identified as Tax Map Keys:(3)2-4-003-022, 2-4-063-120, and 2-4-063-121,
delineated on Exhibit "A" attached hereto.
BE IT FURTHER RESOLVED that the Corporation Counsel of the County of Hawaii be
and is hereby authorized and empowered to initiate proceedings in eminent domain, as provided
by law, for the taking, acquisition and condemnation of the aforesaid private properties.
BE IT FURTHER RESOLVED that in the process of said proceedings in eminent domain,
the Corporation Counsel be and is hereby authorized and empowered to negotiate terms of
settlement in accordance with Section 2-10, Hawaii County Code, and the approval of the court
before which such proceedings are prosecuted.
BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is directed to transmit
copies of this resolution to (1) the Honorable Harry Kim, Mayor of the County of Hawaii; (2) the
Department of Public Works; (3) the Office of the Corporation Counsel; and (4) Allan K. Okuda
and Kwi N. Okuda, 412 E. Puainako Street, Hilo, Hawaii 96720, the owners of Tax Map
Key:(3)2-4-003-022; (5) Walter S. Murasaki and Edna E. Murasaki, 1035 Ualana Place, Hilo,
Hawaii 96720, the owners of Tax Map Key:(3)2-4-063-120; and (6) Leigh H. Mizusawa and
Sandra M. Mizusawa, 1049 W. Kawailani Street, Hilo, Hawaii 96720, the owners of Tax Map
Key:(3)2-4-063-121.
