Re: Amendment to the Hawaii County Code
Enclosed is a bill for an ordinance amending Chapter 2 and Chapter 18 of the Hawaii
County Code, relating to Mass Transit. This bill amends Chapter 2, Article 2, Section 2-7,
Organization of executive branch, by properly identifying. the departments and agencies
under the direct or administrative supervision of the managing director, instead of the
Mayor, pursuant to the 2000 Charter Amendments. For consistency, it also amends
Chapter 2, Article 14, Mass Transportation Agency, by replacing all references of "mass
transportation" and "transportation coordinator" with "mass transit" and "mass transit
administrator", respectively. The last amendment is to Chapter 18, Article 1, ®ivision 1,
Section 18-4, to reflect the recent conversion of the mass transit administrator position
from exempt to civil service and to note it now as the agency's chief administrator.

A. REQUEST:
Amend the following articles and sections of the Hawaii County Code (see attached for specifics):
1) Article 2. Executive Branch. Section 2-7. Organization of executive branch.
- items (1), (C), (D), (3)
2) Article 14. Mass Transportation Agency.
3) Section 18-4. Transit operations coordinator as chief administrator.
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Amending Article 2, Executive Branch, Article 14. Mass Transportation Agency, and Section 18-4. Transit
operations coordinator as chief administrator, to reflect changes pursuant to the 2000 Charter Amendments
and to reflect classification actions taken.
a) Pursuant to charter amendments, department/agency heads are now under supervision of the managing
director.
b) The County Code, Article 2, Section 2-7. Organization of executive branch, identifies the Mass
Transportation Agency as Mass Transit. Thus, to be consistent, amending all references of "mass
transportation" to "mass transit".
c) The Mass Transit Administrator was classified as an exempt, appointed department head; however, the
County Charter did not identify the Mass Transit Agency as one of the departments in the
Executive Branch.
d) The County Code, Article 2. Section 2-7. Organization of executive branch, includes Mass Transit with
other County agencies, e.g. Civil Defense Agency, Office of Aging.
e) The County Code, Article 14. Section 2-76. Creation, identifies the Mass Transit Agency's single function
to provide mass transportation for the County of Hawaii whether directly, jointly, or under contract with
private parties. These characteristics, i.e., single function and scope of services, are comparable to that
of the Office of Aging and the Civil Defense Agency, and not characteristic of the other departments with
multi-functions and services.
f) The head of these agencies are civil service.
g) Pursuant to Hawaii Revised Statutes, Section 76-16 (g),(h) Civil service and exemptions,
position no. 3355 Mass Transit Administrator was converted to civil service.
h) Title of position changed from "Coordinator" to "Administrator" to reflect the role of the position as head of
an agency.

Article 14. Mass J~eesfle~tetieeJ Transit Agency.
Section 2-76. Creation.
For the purpose of providing mass [ttanspeA:Hien] transit service in the County whether directly, jointly, or under
contract with private parties, an agency to be known as the mass [transperiaEien] transit agency is created in order to
implement chapter 51 of the Hawaii Revised Statutes.

There shall be a [ ~ mass transit administrator.

mass transit administrator shall be in the civil service and shall be filled through civil service recruitment procedures
based on merit.

Section 2-78. Duties of ~ ]mass transit
administrator.
The ( ]mass transit administrator shall have direct responsibility for the administration and
operation of County mass [tertatien] transit service, whether such service is provided directly, jointly, or under
contract with private parties. The [ ~ mass transit administrator shall be under the direct
supervision and control of the mayor and shall have the authority to staff the agency with necessary personnel to
carry out the purposes of the agency.

The [ ] mass transit administrator shall be the chief
administrator and he may assign any clerk, stenographer, agent or other assistant from
the mass transportation agency to the commission as may be necessary and define their
powers and duties
