HomeMy WebLinkAboutRES 174 Draft 01 2002-2004 COUNTY OF HAWAII STATE OF HAWAII RESOLUTION NO. 1'7~ 0~~ RESOLUTION AUTHORIZING THE 1) EXTENSION OF THE PUBLIC SEWER ALONG ALAHOU STREET; AND 2) REIMBURSEMENT FOR THE COST OF CONSTRUCTION OF THE EXTENSION FOR ONIX MANAGEMENT, INC. AT KAILUA-KONA, HAWAII. WHEREAS, applicant Onix Management, Inc. has submitted an application to extend the sewer along Alahou Street in accordance with Section 21-26, Hawaii County Code, with said application and construction plans being attached hereto as Attachment "A"; and WHEREAS, sewer extensions are beneficial to the community by eliminating existing cesspools and reducing the amount of pollutants reaching the groundwater and the coastal waters, resulting in a cleaner, healthier environment; and WHEREAS, Section 21-26, Hawaii County Code, requires that all sewer extensions shall be approved by the County Council by resolution; and WHEREAS, applicant Onix Management, Inc. has proposed to construct the sewer extension in accordance with Section 21-28(a), Hawaii County Code, regarding payment of costs; and WHEREAS, the Director of the Department of Environmental Management has recommended approval of the sewer extension; and WHEREAS, in accordance with Section 21-28(a), Hawaii County Code, the applicant may receive for ten years after completion of the extension one-half of all monies for sewer charges collected by the County from other properties connecting to the extension, provided the total of such reimbursement shall not exceed the cost incurred by the applicant to construct the extension, and plans to reimburse applicant for construction of sewer extensions shall require the approval of the County Council by resolution. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the sewer extension along Alahou Street by Onix Management, Inc. is hereby approved. BE IT FURTHER RESOLVED that the request of Onix Management, Inc. t be reimbursed for the cost of the sewer extension along Alahou Street in accordance with Section 2 -28(a), Hawaii County Code, is hereby approved. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii tran mit copies of this resolution to Onix Management, Inc. and the Departments of Finance and En ironmental Management.
