RESOLUTION NO. 175 04
RESOLUTION AMENDING THE DISTRICT DISTRIBUTION FORMULA OF THE
COUNTY OF HAWAII FUEL TAX PROGRAM.
WHEREAS, Resolution 397-88, adopted by the Council of the County of Hawaii on Mazch 15,
1988, provided an additional 3.8 cents per gallon increase in the county fuel tax rate; and
WHEREAS, the revenues generated by the 3.8 cent fuel tax increase are expended based upon the
apportionment formula developed by the Department of Public Works and are used for highway
improvement projects; and
WHEREAS, Resolution 192-97 extended the Special Fuel Tax Program to June 30, 2008; and
WHEREAS, the existing district allocation formula equally divides the fuel tax revenues into two
categories: (1) TEA (Transportation Equity Act of 1998, formerly ISTEA, also known as TEA21) Projects
and (2) Local Road Improvement; and
WHEREAS, the Local Road Improvement category distributed funds among the tax map districts
according to each district's percent of miles of local streets, and percentages are calculated biennially to
accommodate newly dedicated roads, abandonments and any other changes in mileage; and
WHEREAS, the number of miles of highway improvement in each district are disproportionate as
there exists a higher material cost for highway improvement projects in North and South Kona, and portions
of North and South Kohala and Ka`u; and
WHEREAS, in keeping with the intent of the periodic update of the distribution formula, the
Department of Public Works has done the necessary fact finding.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF
HAWAII that the district distribution formula for the Local Road Improvement category is hereby amended
as follows:
l . The Local Road Improvement category revenues generated by the fuel tax increase shall be expended
based upon an apportionment formula to be developed by the Department of Public Works that factors in
any higher material cost for highway improvement projects as delineated in the Sample Exhibit A, herein
attached.
2. That the said apportionment formula shall be updated biennially.
BE IT FURTHER RESOLVED that this resolution shall take effect on July 1, 2004.
BE IT FURTHER RESOLVED that if any provisions of this resolution or the application thereof to
any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications
of this resolution which can be given effect without the invalid provision or application, and to this end the
provisions of this resolution are declared to be severable.
BE IT FURTHER RESOLVED that the county clerk is hereby instructed and directed to send a
copy of this resolution to the Honorable Harry Kim, Mayor, County of Hawaii; Bruce C. McClure, Director,
Department of Public Works; and to William Takaba, Director of Finance.
