WHEREAS, the Council of the County of Hawaii, on July 31, 2001, approved passage of Resolution 99-01 authorizing the Director of Finance to dispose of real property, being Parcel 11, a portion of Royal Patent Grant No. 2026 to Kaheana, situate at Kauhako, South Kona, Island, County and State of Hawaii, Tax Map Key:(3)8-6-009:011, to the Department of Water Supply as a site upon which to build the Ho'okena standpipe facility; and WHEREAS, pursuant to Resolution 99-01, a Quitclaim Deed was recorded with the Bureau of Conveyance transferring Tax Map Key:(3)8-6-009:011 to the Department of Water Supply; and WHEREAS, the Department of Water Supply did not build the standpipe facility on Tax Map Key:(3)8-6-009:011; and WHEREAS, the Department of Water Supply on February 26, 2004 communicated to the Director of Finance that the Department of Water Supply has decided not to build the standpipe facility on Tax Map Key:(3)8-6-009:011; and WHEREAS, the Department of Water Supply desires to return said parcel to the County of Hawaii via Quitclaim Deed (Exhibit "1 and WHEREAS, the Water Board at its February 24, 2004 meeting approved the conveyance back to the County of Hawaii; and WHEREAS, the Director of Finance, on behalf of the County of Hawaii, desires the return of said parcel; and WHEREAS, Sections 1-6 and 1-7, Hawaii County Code, allows the Council to repeal any resolution or ordinance.
