Thank you for your previous letter to us regazding Earth Awaze/Hamakua Ecology
Center. The information you provided us was very helpful.
Enclosed please find two flyers for an event happening March 21st-27s' at the Hamakua
Ecology Center. Per your letter to us dated Mazch 1, 2004, the Ecology Center is not to
be holding any events or doing any advertising until they have been issued a permit. I
would ask that you take the appropriate action regarding this matter.
Please include this information in the Special Application file for Earth Aware.
I would also like to know what action has been taken. Please let me know in writing.

This is to acknowledge receipt of your letters received March 22, 2004 and April 12,
2004 regarding the above listed special permit application. The letters will be included
within the special permit file.
The following will be answers to your questions in the March 22, 2004 letter listed in
numerical order:
1. The Planning Department logs, numbers and assigns all correspondence to the
appropriate staff member. The staff member that handles complaints and
violations is our Zoning Inspector, Robert Usagawa. When a complaint is
received, he will follow up on the complaint and issue a violation notice, warning
letter or closure letter depending on the outcome of the inspection.
2. The letter submitted by yourself to the Planning Department was assigned to our
Zoning Inspector, Robert Usagawa. It has been made part of the complaint file.
He is taking your letter and information submitted from other members of the
public into account as he is conducting his investigation. For your information,
violations of an association's CC and R's are a civil matter and need to be

pursued in civil court, not through the Planning Department. We are following up
on violations of the Zoning Code that maybe occurring.
3. If the violations occurring are a violation of your association's CC and R's, it
would be appropriate to pursue this in civil court. If the violations occurring are
against the Zoning Code, the community members can write or call the Planning
Department to report these possible violations. Our Zoning Inspector, Robert
Usagawa, will follow up on the complaints and will issue a violation notice,
warning letter or closure letter depending on the outcome of the inspection, as
stated above. Please be aware that we have one zoning inspector that covers Puna
to North Kohala. He will be able to conduct inspections (or follow-up
inspections) as his workload allows.
As requested, the correspondence submitted herein and previously has been made part of
the special permit file.
This letter also acknowledges receipt of the recent letter received on April 12, 2004 and
will make it part of the special permit file.

Dear Mr. Yuen:
As concerned neighbors of the Hamakua Ecology Center, we are writing to thank you for
your letter to Lisa and Scott Anderson, dated Mazch 1, 2004. The information contained
therein was quite helpful. We have had several meetings involving members of the
Kapulena Orchards Community Association (KOCA) and the staff of the Hamakua
Ecology Center (HEC) in an effort to have HEC withdraw their special use application as
an act of good faith with the Community and a first step in discussing radically different
alternatives to their application that might be more acceptable to the Community. We are
having a formal General Meeting of the Community on Mazch 27 to continue this
dialogue.
In prepazation for this important meeting, we would appreciate your answers to a few
more (interrelated) questions so that we can be better informed about the application
process and the enforcement of County regulations.
1. In your Mazch 1 letter you stated (Question No. 6, Pazagraph 2): "The applicant is not
to advertise or continue operation of the illegal use until a special permit is obtained.
Please call our office if the use continues." Over the past few months, members of our
Community have called and written your office several times about events and retreats
that are still taking place at HEC and continued advertising of HEC programs in a variety
of journals, web sites and other places despite the County's cease and desist order of
last July. (We can document the appearance of these advertisements if you so desire.)
We would like to know how the County processes our calls that indicate County
directives are not being followed by HEC and, if and when the County determines a
violation has occurred, what actions do you take?
2. Jack Zimmerman, President of Kapulena Orchards Community Association, sent you
a letter dated February 11, 2004, indicating that the Community was concerned about the
continued activity at HEC despite the County's cease and desist order. We have not
received a reply or acknowledgement of this letter and would like to know what the
County's policies are regarding responses to such correspondence. It is difficult for our
Community to come to clarity about HEC's plans if we do not understand how the
County deals with violations of special use applications should they be granted in the
future.

3. What role is appropriate for our Community to take in regard to these matters? Does
the County routinely inspect properties that are in violation of directives and/or special
use permits or does the County depend on local information to activate a response. Who
at your office is the best person to handle our concerns and calls about violations of
County regulations, whatever they might be?
We also would like to request that all of our previous correspondence regazding Earth
Aware TMK 4-7-06-016, along with this letter and all future correspondence, be entered
into the permanent special permit file for Earth Aware number SPP 04-004. We would
also like all of the information we have provided and will provide in the future to be
included in the file you present to the Planning Commission.
Many KOCA members are in strong opposition to the special application submitted by
HEC and aze prepared to participate in County hearings and other activities to express
their concerns. Our General Meeting on March 27 will give all members a chance to
express these concerns to the HEC Staff in the hope that they will significantly modify
their application, as well as their past history of not abiding by County regulations. Your
response to our questions in advance of the meeting will be greatly appreciated.

Special Permit Application 04-004
Dear Mr. Yuen:
A general meeting of the Kapulena Orchards Community Association (KOCA) was
convened on March 28, 2004 in order to further discuss the subject Special Permit
Application (SPA). Of the 18 cun•ent members of KOCA 14 were present in person and
one by proxy. Representatives of the property owner applying for the special permit and
the Hamakua Ecology Center (HEC) were present. All members had full opportunity to
share their views about the SPA. As a result of the discussion, the following motions
were approved by large majority votes:
1. The membership of KOCA is in opposition to the Special Permit Application 04-
004 and a letter to this effect is to be sent to the County of Hawaii Planning
Department.
2. (a) The KOCA Membership requests that HEC withdraw SPA 04-004 as soon as
possible.
(b) KOCA will create a special committee, including members from the applying
property and HEC, to see if some agreement can be reached regarding a
significantly reduced form of activity on the subject property that could be
approved by a majority of KOCA Members. This committee will also propose a
revised set of CC&Rs to the KOCA Board (before August 1, 2004) that reflect the
present Community's long-term ideals.
This letter fulfills the first of these motions. Please make it an official part of the SPA
04-004 file.
