The plan shall consist of an archaeological data recovery plan and a preservation plan. Approved mitigation measures shall be implemented prior to or in conjunction with any land alterations in the project area." With the submittal of the above listed plans and approval letters from the Department of Land and Natural Resources-Historic Preservation Division, we find that the requirements of Condition N of Change of Zone Ordinance No 92-40 (REZ 710) have been fulfilled, except for the implementation which will occumng during subdivision. The plan outlines interim and long-term preservation measures for two historic sites located in the Makai 46 Subdivision, a 46-acre portion of the Kohala Ranch Project District (Project IV) that is intended to be developed as a residential subdivision. The sites include a section of the Kawaihae-Pu'uhue trail/roadbed (Site 11071) and a temporary habitation site (Site 23633). Both sites are proposed for preservation "as is," with no stabilization, rehabilitation, restoration, or reconstruction. Each site will be minimally interpreted with signage. We have several comments, requiring some minor alterations to the plan. These refer, for example, to the need to establish permanent buffer zone sizes and also to the need for monitoring. Please see the attached for details. Also, in preparing a revised plan we recommend that you consult with the Na Ala Hele program to see if they have any interest in or concerns about the proposed preservation measures for the Kawaihae-Pu'uhue trail. Please call Dr. McCoy and discuss this issue with him. Then, as needed, the plan can be revised accordingly. Site 11071 (Kawaihae-Pu'uhue traiVroadbed) 1. The plan indicates that only selected portions of the Kawaihae-Pu'uhue trail/roadbed will be preserved and that the selection process will be made sometime in the future. There is no justification for this approach in the plan. In your discussion with Patrick McCoy on December 23, 2002 you indicated that partial preservation was the recommendation made in the archaeological inventory survey report that documented and evaluated the site and that our office had agreed with that recommendation. This agreement should be noted in the plan. Also, the selection of which portions to be preserved must be made now and be included in the interim protection measures. 2. The description of the trail/roadbed indicates that it traverses different kinds of terrain, including gullies. The variability in slope suggests that a uniform 10-foot wide interim buffer on each side of the trail/roadbed may not be adequate to protect and preserve this site and its environmental setting. We believe that you need to reassess the proposed 10-foot buffer in light of these factors, the proposed development plans, and Na Ala Aele's interest in the trail, if any. The interim buffer would be in place until the long-term preservation plan is implemented. This phased approach is acceptable, but only under the condition that there is an approved final buffer. Such an approved final buffer is the first requirement of any preservation plan. The plan should include a proposed final buffer. Site 23633~temQoraryhabitation) 1. The location of Area A in the description of Feature A on page 8 does not agree with the location in Figure 5, which shows Area A much further to the south. Please review and make the necessary corrections. 2. A 10-foot interim buffer zone for the temporary habitation site would seem to be adequate, but as with the trail/roadbed, you also need to include a proposed final buffer. The plan was prepared for Kohala Ranch LLC to fulfill Condition N of Hawaii County Ordinance No. 92- 40. The current plan includes plans for data recovery, interim site preservation, and site preservation and interpretation for 18 sites located in a roughly 930 acre portion of the Kohala Ranch Development project area referred to here as the Project IV area. The mitigation treatments for these sites and a burial site (11073) were approved in a June 12, 199G letter to the Hawaii County Planning Department (Hibbard to Duane Kanuha). The mitigation treatments for the burial are outlined in a separate burial treatment plan that will be reviewed by our office. An archaeological mitigation plan for another portion of the Project IV area (the Makai 46 Subdivision) was recently reviewed and approved by our office (Log No. 31586; Doc No. 0301PM10). We have the following comments on each of the individual plans. Data Recovery Plan Data recovery investigations will be conducted at four sites (11066, 11067, 11068 and 11070), all of which were interpreted as temporary habitations when they were first recorded during reconnaissance surveys in 1986, 1987 and 1990. One objective of the proposed research is detailed recording of the sites, which were only briefly described and sketched during the earlier surveys. We agree that obtaining better quality site data is a valid and appropriate objective for the sites in question, but we believe that there is a need to obtain these data prior to developing a final data recovery plan. The quality of the existing survey data poses a major problem in our view in terms of determining appropriate research topics and questions. The problem is briefly alluded to in your discussion of site specific data recovery tasks on page 11 and on page 15 in reference to the poor quality sketch maps in the reconnaissance survey reports. We suggest that you recommend to your client a resurvey of the four sites to bring the data up to current inventory survey standards for the purpose of preparing a more realistic data recovery plan. As part of the survey we recommend that you conduct test excavations to determine the nature of the cultural deposits (e.g. types and quantities of midden, artifacts and features) and the kinds of research questions that could be profitably addressed during a data recovery phase. zQ03 RECEIVED FEB 3 Dr. Paul Rosendahl Page 2 When you revise the data recovery plan we think that you need to give more thought to the choice of research questions in terms of whether a question can be realistically addressed with currently available methods or techniques. We have serious doubts about the ability to address some of the specific research questions outlined in the current draft plan. We don't believe that it is possible, for example, to distinguish between sites used for multiple contiguous nights,° and those used for "weeks at a time.° We also don't think it is possible to establish with any degree of certainty the contemporaneity of features on a single site. Interim Preservation Plan The interim preservation plan is predicated on the assumption that construction can begin prior to the completion of data recovery and the de~•relopment of a final preservation olan. As you know, we are generally willing to allow construction to proceed after the completion of data recovery fieldwork, if there are no burial sites in or near the area and with the additional understanding that an acceptable report will be submitted within a reasonable time period. We are also generally willing to allow construction to proceed in project areas with preservation sites on the condition that there are approved final buffers and other protective measures. The lack of good site maps presents a major problem in this case. As you note on page 15, the maps in the reconnaissance survey reports are inadequate and in some cases the site boundaries are unclear or unknown. We are unwilling to approve interim buffers until the sites have been accurately mapped. The maps, particularly those for the preservation sites, should be done at a scale suitable for immediate planning purposes, as well as for long-term management purposes. The buffers for the 12 preservation sites located in gulch areas are not as crucial since the gulches will not be developed. Long-term Site Preservation The long-term preservation measures for the 14non-burial sites are generally acceptable. We suggest that you also note that the easements for all of the preservation sites will be plotted on subdivision plat maps. The statement on page 20 pertaining to execution of the site preservation and interpretation plan should be changed to note that the landowner, rather than SHPD, will verify in writing to our office and to the County that the plan has been successfully implemented. In summary, we believe that the existing reconnaissance survey data are generally inadequate for the purpose of preparing an acceptable final mitigation plan for the sites in the Kohala Ranch Development Project IV area. The only recourse in our view is to conduct additional fieldwork to bring the data up to current inventory standards and then prepare a revised mitigation plan based on the new data. The results of the additional fieldwork could be presented as either an addendum to the earlier survey reports, or as a new inventory survey report. We expect that this problem will arise in the future -where older survey reports are found to be inadequate for the purposes of fulfilling mitigation requirements at a later time -and we shall develop a policy statement to deal with these kinds of situations. In the interests of ensuring appropriate recordation of, and mitigation of "adverse effects" to the historic sites known to be in the Project IV area, we will agree to a phased mitigation plan. The first phase will consist of documentation and a re-evaluation of site significance and mitigation needs. The second phase will consist of implementing the agreed upon components of the subject mitigation plan: data recovery, preservation, and burial treatment, following completion of the first phase. We ask that you incorporate the relevant comments pertaining to the data recovery and preservation plan components contained in our letter of January 30, 2003. To the extent that staff workload permits, we will expedite review of the results of the first phase of field work so as not to delay execution of the second phase. During the discussion of the preservation measures, the Hawaii Island Burial Council mentioned their concerns regarding the adequacy of the azchaeological inventory survey, and the possibility of requiring a new inventory survey for the project. Also, the HIBC recommended that inadvertent burials found on the project be treated as previously identified. The Attorney General's Office will look into this matter, and determine if this recommendation is enforceable. However, this will not affect the H1BC's determination made on May 15, 2003. At the end of the HiBC meeting, a motion was made to recommend a 250-foot buffer surrounding site 11073. The department wishes to clazify with the HIBC the concerns of the Council which led to the buffer recommendation. The plan, which was prepared for Kohala Ranch LLC to fulfill Condition N of Hawaii County Ordinance No. 92-40, was revised to respond to the comments in our review letter of January 30, 2003 (Log No. 31587; Doc No. 0301 PM11). The current draft plan supersedes PHRI Report 2275.3-042203, which was submitted to our office on May 6, 2003. This latest version of the plan was prepared after the conclusion of a resurvey of the four proposed data recovery sites (11066, 11067, 11068 and 11070). The resurvey found that the four sites do not contain cultural remains and deposits. In our review of your draft report on the resurvey (Log No. 2003.1290; Doc No. 0307PM20) we agreed that the four sites have been satisfactorily mitigated. Several changes were made to the Site Preservation Plan component of the Mitigation Plan as summarized below: Interim Preservation Plan Our January 30, 2003, letter expressed our concern with the lack of good site maps and indicated our unwillingness to approve interim buffers until the sites had been accurately mapped. We noted that the maps should be done at a scale suitable for immediate planning purposes, as well as for long-term management purposes. We also noted that the buffers for the 12 preservation sites located in the gulches were not as crucial since the gulches are outside of the area of proposed development. Dr. Paul Rosendahl Page Two Your plan now includes a map showing 10 foot wide interim preservation buffers for the two trail sites (11071 and 11075) located outside of the gulches. You indicate that the corners of the 12 gulch sites are marked with flagged poles and that flagging will be placed along the edges of the gulches in the vicinity of the sites, as specified in a June 12, 1990, letter from former division head, Don Hibbard, to Duane Kanuha, formerly with the Hawaii County Planning Department. We believe that these and the other interim preservation measures outlined in the plan will adequately protect the 14 non-burial sites during the development of the planned residential community. Long-term Site Preservation Per our recommendation, the plan now stipulates that the easements for all of the 14 non-burial preservation sites wilt be plotted on subdivision plat maps and that the landowner will verify in writing to our office and to the County that the plan has been successfully implemented. The revised mitigation plan meets with our approval, except for the absence of any commitment to prepare new and accurate site maps for the preservation sites. We believe that good site maps are essential for long-term management purposes, even for the 12 gulch sites that will be preserved "as is" with no interpretive development. The preparation of these maps could be done at a future date, but within a reasonable time period and prior to the completion of the development. If this is acceptable to your client, please add site mapping to the long-term site preservation plan. The report was prepared in response to the comments in our review letter of January 30, 2003 (Log No. 31587; Doc No. 0301 PM11) on your draft mitigation plan for Sites 11066, 11067, 11068 and 11070 in the Kohala Ranch Development Project IV area. Our January 30, 2003, letter noted the inadequacy of the existing reconnaissance survey data for the four sites, and recommended a resurvey to bring the site data up to current inventory survey standards as the first step in preparing an acceptable final mitigation plan for the Kohala Ranch Development Project IV area. As part of the resurvey we recommended that you conduct test excavations to determine the nature of the cultural deposits (e. g. types and quantities of midden, artifacts and features) and the kinds of research questions that could be proftably addressed. Your report presents the results of the resurvey, which was conducted over a three day period in May 2003. All four sites were relocated, mapped, and recorded in detail. No portable cultural remains were found at any of the sites, and soil deposits were found in only one feature at Site 11067 and one feature at Site 11068- No cultural remains were found in shovel tests of the two features. We agree that all four sites are significant only for their information content under Criterion "d". We also concur with your recommendation for no further work. The detailed site recording and testing have adequately mitigated the four sites, which Dr. Paul Rosendahl Page Two will now be removed from the mitigation plan for the Kohala Ranch Development Project IV area. Your addendum report to the earlier reconnaissance survey reports meets with our approval, except that we believe that there is a need to add a brief summary of work and a discussion of the probable age and function of the four sites and their relationship to other sites in the project area.
