Sewer Connection Exceptions
Administrative Variances vs. Council Variances
Bill No. 250 proposes to allow the Director of Environmental Management to grant
administrative variances to sewer connection requirements.
QUESTIONS:
l . If Bill No. 250 was amended to allow the County Council to grant these variances
instead, what legal consequences arise in view of Kaahumanu v.r. County qJ'
Maui?
2. What appellate body would review the variance decisions of the:
A. Director of Environmental Management?
B. County Council?
I would appreciate a response prior to the next May 5, 2004 Council meeting.
