Comm. 599: AN ORDINANCE AMENDING CHAPTER 14, ARTICLE ] 0, SECTION 14-63, OF (Bill 263) THE HAWAII COUNTY CODE (1995) RELATING TO EXCEPTIONAL TREES (Amends the section on Violation and penalty). From Leonard Bisel, Chairperson, Arborist Advisory Committee, dated April 1, 2004, transmitting the above bill. States that after reviewing the existing County Ordinances regarding exceptional trees, their committee felt that protection of these magnificent trees needed to be strengthened. The current Ordinance only provides a penalty if a tree is removed or otherwise destroyed. There are times when trees are not removed or destroyed but may be substantially damaged by vandals. Also proposed is an amendment to allow a penalty to be assessed "per tree or incident" in recognition of places where a grove or stand of trees has been designated as exceptional.
