Enclosed for your review and approval is a bill, amending Chapter l4, General Welfare to
establish a new section to address the military unexploded ordnance. The purpose of this bill is to
establish a repository for confirmed locations of unexploded military ordnance and explosive
devises on the island of Hawaii and surrounding coastal ocean areas up to 1,000 meters deep to
mitigate the unexploded military ordnance hazards through full disclosure. The 1,000-meter
depth has been placed in the ordinance, but I understand that the County's jurisdiction does not
extend beyond the shoreline. Civil Defense Agency, through its administrator, shall be the
repository agency for pertinent data of unexploded military ordnance and explosive device sites.
This bill also requires the Civil Defense Agency to report annually to the County Council.
Currently, no agency is responsible for documenting and inventorying this information. The
documentation may he iu several different agencies' data banks. Whenever the public reports
possible unexploded ordnance, the police department is notified and they will investigate and
secure the affected area. The police personnel will not handle the unexploded ordnance; instead
they will call the Explosive Ordnance Detail of the Department of Defense (DOD). The DOD is
responsible for assisting the County in the detection, identification, field evaluation, rendering
safe, recovery, evacuation, and disposal of military explosive devices of unexploded ordnance.
Again, no agency is responsible for the repository function.
Also attached is a memo from'froy Kindred, Administrator of the Civil Detanse Agency, dated
March 9, 2004, which concurs with the concept subject to additional resources.

Thank you for your correspondence. Overall, I feel the Unexploded Military Ordnance Bill
will he good for our community and children. Unexploded military ordnance is an
overlooked responsibility that has, due to the complexity of the issue, always been a grey
area and seldom tracked "well" by anyone.
This will constitute a new requirement on our office, and will represent a challenge to
collect, organize, and maintain vigilance on a large volume of complex locations with
many entangled responsibilities.
I will begin concept planning immediately in order to be better prepared when this goes
through. Hopefully the Council will look favorably if additional resources are rcyuired to
effectively meet the requirements of the bill. We will work that issue if and when it arises.
