These funds, derived from the Department of Homeland Security, Office for Domestic Preparedness (ODP), are to provide law enforcement communities with enhanced capabilities for detecting, deterring, disrupting, and preventing acts of terrorism. Enclosed is a resolution to authorize the Mayor to enter into an agreement with the State of Hawaii Department of Defense, State Civil Defense. Also enclosed is a bill for an ordinance amending the Operating Budget by appropriating this $456,544 Law Enforcement Terrorism Prevention Program Grant. Due to the State Civil Defense's signing deadline of May 28, 2004, the Hawaii County Civil Defense Agency would like to request a waiver from the Finance committee and have this resolution and bill heard at the Council meeting scheduled for May 19, 2004. REQUEST: To prepare a resolution to enter in an agreement and to accept a grant of $456,544.00 from State Civil Defense to be used for the development of its Law Enforcement Terrorism Prevention (LETPP) program. Also, please prepare a bill for an ordinance to appropriate funds. We request to waive Finance Committee due to State Civil Defense's request signed copy be returned by May 28, 2004. B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): The State of Hawaii has received funds for FY 2004, from the Department of Homeland Security, through the Office of Domestic Preparedness. The grant is a result of congressional funding for the purchase of specialized equipment to enhance the capability of county agencies to prevent, deter, respond to and recover from threats and acts of terrorism. The funds are to support the development of a Law Enforcement Terrorism Prevention Program (LETPP). The LETPP provides law enforcement communities with enhanced capabilities for detecting, deterring, disrupting, and preventing acts of terrorism. The FY 2004 LETPP provides funds for the following activities: 1) information sharing to preempt terrorist attacks; 2) target hardening to reduce vulnerability of selected high value targets; 3) threat recognition to recognize the potential or development of a threat; 4) intervention activities to interdict terrorists before they can execute a threat; 5) interoperable communications; and 6) management and administration. Hawaii County, in turn has been awarded $456,544.00 for such purposes and needs to enter into an agreement with State Civil Defense in order to receive these funds. The FY 2004 Grant Program funds are provided to prevent, deter, respond to and recover from threats and acts of terrorism. The FY 2004 funds are provided and administered in three programs State Homeland Security Program, Law Enforcement Terrorism Prevention Program and Citizen Corps Program. The three programs are integrated to better facilitate the organization and coordination. This grant is a result of congressional funding for the purchase of specialized equipment to enhance the capability of state and county agencies to prevent and respond to incidents of terrorism involving the use of chemical, biological, radiological, nuclear or explosive (CBRNE) weapons. The law enforcement terrorism prevention funds enhance capabilities for detecting, deterring, disrupting, and preventing acts of terrorism through information sharing and intelligence gathering, target hardening to reduce vulnerability and intervention activities to interdict terrorists before they can execute. The Citizen Corps Program funds will be used to support Citizen Corps Councils with planning, outreach, training and management of Citizen Corps programs and activities. State Civil Defense has been designated as the recipient of the total allocated grant funds. The grant funds are distributed in the three programs below: State Homeland Security Grant Program $ 1,960,060.00 Law Enforcement Terrorism Prevention Program 456,544.00 Citizen Corps Program 29,440.00 The FY 2004 Grant Program continues to provide Hawaii County with funding for planning, equipment, training, and exercises to support emergency prevention, preparedness, and response personnel. Hawaii County response agencies should utilize the State Homeland Security Assessment and Strategy to more effectively fill the gaps between needs and existing capabilities. All funds will be recorded in an Initial Strategy Implementation Plan (ISIP) that identifies expenditures. The detailed budget worksheets and an ISIP portraying the use of the FY 2004 Grant Program funds will be provided to Hawaii Civil Defense Agency by June 6, 2004. For your review, the terms and conditions of the grant program funds being distributed to Hawaii County are in the attached Articles. This grant has no match requirement. If you agree to the requirements of the grant, please sign and return the original copy of each Article to State Civil Defense before May 28, 2004. To be eligible for future funding, the State has three requirements that must be fulfilled - • The State must adopt the National Incident Management System (NIMS) (as mandated by HSPD-5, beginning in FY 2005); • Develop a State Communications Interoperability Plan; and • Develop a State Homeland Security Exercise and Evaluation Program. Hawaii County will be a vital partner in the development of these plans and programs. Thank you for your cooperation in expediting this initiative. Pursuant to Section t (g) of Rule 4 of the Rules of Procedure of the Council of the County of Hawaii, this written request is submitted with my approval that the above-referenced matter be waived from the Committee on Finance to the full Council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter placed onto the next Council agenda for review.
