Please appropriate the $10,000 increase into Fire's General Fund grant revenue account, numbered 3303.00 and titled "Volunteer Fire Assist" and into their expenditure account, numbered 010-221-5221.38 and titled "Voluntr Fire Assist -Fed"; bringing the total of both accounts to $60,000. Also, the Department of Environmental Management's Solid Waste Division has been notified that they are the recipients of a $10,000 Fats, Oils and Grease Study grant from the State of Hawaii, Department of Business, Economic Development & Tourism (DBEDT). These funds will be used to conduct a study to determine the market potential for the production of biodiesel based on current generation levels of Fats, Oils and Grease. We ask the Council to include this DBEDT grant in the FY2004-05 operating budget by creating the General Fund revenue account, numbered 3305.36, and the expenditure account, numbered 085-601-5604.34, both titled "Fats, Oils and Grease Study". If at this time, the Council elects not to act upon our request to amend the proposed FY 2004-05 budget, we will submit the proper resolution and bills to appropriate these grants in early July. ~ p Comm. Kaya, Chief Technology Officer (REPRESENTATIVE)-and the County of Hawaii, hereinafter referred to as CONTRACTOR, whose principal address is 25 Aupuni Street #214, Hilo, Hawaii 96720, Taxpayer I.D. number 99-6000567 for services related to an assessment of the potential for a biodiesel industry on the Big Island of Hawaii. The parties hereto agree to the terms, conditions, and provisions as follows: 1. Scope of Services. CONTRACTOR shall provide the following services: a. Conduct a study to determine the market potential for the production of biodiesel based on current generation levels of FOGS (Fats, Oils and Grease). Such work shall include, but not be limited to: i. Assessment of the current amount of cooking oil being land filled and/or diverted from landfill through the County's diversion program. ii. Conduct of a survey of restaurants and eating establishments in the County to estimate the current amount of FOGS being generated. iii. Based on a comparative cost analysis, and review of relevant incentive programs in the state, determination of an appropriate rate For the cooking oil diversion program to create incentives for converting FOGS into biodiesel. b. Submit for STATE approval a survey instrument and survey methodology pursuant to 1. a. ii. which shall include quantification of the targeted survey population. c. Submit for STATE approval a final report, which shall include a summary of all survey data collected, assessments of current quantities of FOGS being landfilled and/or diverted, recommendations on appropriate rates for the cooking oil diversion program that will promote the collection of FOGS for conversion to biodiesel, and recommendations for appropriate implementation steps toward a County wide biodiesel program. 2. Time of Performance. The services described herein shall commence upon the effective date of this Agreement, and shall be completed by December 31, 2004. a. This letter of Agreement maybe extended for a total period of time not to exceed three (3) months. However, the initial extension shall not exceed one (1) month with one additional extension allowable that shall not exceed two (2) months. The CONTRACTOR shall submit any extension request in writing for STATE approval a minimum of one (1) month prior to the termination of the contract. Said request shall provide detailed reasons for the delay in and steps to be taken to ensure the timely completion of the project. If the STATE approves the extension request, an amended Letter of Agreement shall be executed by both parties in accordance with the General Conditions. The CONTRACTOR shall not be entitled to any additional compensation to complete the work described in the Letter of Agreement. 3. Compensation and Method of Payment. In consideration for services to be rendered under this Agreement, STATE agrees to pay a total sum of money not to exceed TEN THOUSAND AND NO/100 DOLLARS ($10,000.00), inclusive of all taxes. This is a firm-fixed fee Agreement and STATE will not provide additional funds beyond the not- to-exceed amount stipulated above. Payment shall be made by STATE in accordance with the following provisions. a. THREE THOUSAND FIVE HUNDRED AND NO/100 DOLLARS ($3,500.00) upon receipt and STATE approval of the work plan for work described in paragraph 1. a., "Scope of Services" herein, and original invoice; b. THREE THOUSAND FfVE HUNDRED AND NO/100 DOLLARS ($3,500.00) upon receipt and STATE approval of the survey instrument and survey methodology pursuant to paragraph 1. b., "Scope of Services" herein, and original invoice; a THREE THOUSAND AND NO/100 DOLLARS ($3,000.00) upon receipt of the final report pursuant to paragraph 1. c., "Scope of Services" herein, and original invoice, and satisfactory completion of all services in accordance with this Agreement. 4. General Conditions. The State of Hawaii, Department of Business, Economic Development, and Tourism, Genera] Conditions, are attached hereto and incorporated herein as Exhibit A. In the event of a conflict between the General Conditions and the Special Conditions of this Agreement, the Special Conditions shall control. For the purposes of this Agreement, subparagraph 19. g. is hereby deleted from the General Conditions and has no operative effect between the parties. 5. Special Conditions. a. The acceptance of this Agreement by the CONTRACTOR serves to bind said CONTRACTOR with regazd to CONTRACTOR'S fulfillment of all terms, conditions, and provisions as set forth in this Agreement. b. U.S. Department of Energy forms: Certifications Regarding Lobbying, Debarment, Suspension and Other Responsibility Matters, and Drug-Free Workplace Requirements; Assurance of Compliance non-Discrimination in Federally Assisted Programs; and Disclosure of Lobbying Activities are attached hereto and incorporated herein as Exhibits B, C, and D.
