The Office of Housing and Community Development (OHCD) respectfully requests that the above-referenced matter be waived from the HCHA to the full Council for action at the next appropriate Council meeting, hopefully, June 2, 2004. Timing is critical to the activities of the Existing Housing Division of the OHCD. Funds must be appropriated by June 30, 2004, for use beginning July 1, 2004. Adoption of a Council Resolution Approving a Multi-Year Lease Agreement for Office Space and Adoption of an Appropriation Ordinance Amending the Operating Budget to Expend Funds to Lease Office Space to Relocate the Existing Housing Division of the Office of Housing and Community Development. Over time the Office of Housing and Community Development (OHCD) staff of the Existing Housing Division (OHCD-EHD) has increased to more than twenty (20) employees. In the 1990's, the OHCD was to have moved into the Real Property Tax Division near the Edith Kanakaole Multi-purpose stadium. When the Real Property Tax Division office space became vacant, the OHCD had outgrown the office space available. In January of 2003, Congress passed changes on the amount of Section 8 administrative fees the OHCD can accumulate and on what the administrative fees can be spent. HUD released Notice PIH 2004-7(HA) on April 22, 2004. The law passed by Congress and the rules issued by HUD are retroactive to October 1, 2003, the beginning of the Federal fiscal period. These changes have forced the OHCD to look at expending approximately $250,000 by June 30, 2004. In effect, the rule changes have forced the OHCD to spend the funds or repay HUD for administrative fees earned but not expended. The OHCD, in consultation with the Finance Department, looked at various options to expend the $250,000. Relocating the OHCD-EHD was determined to be the best recommendation in order to expend the funds in a timely manner and to provide the OHCD-EHD with a long term benefit. As part of negotiations with the proposed landlord, the OHCD estimates that it will need about $500,000 to renovate the building to occupy the space. The estimate includes electrical, telecommunications, air conditioning and interior partitions. 1367hea[.doc V,$,1. - 1 The OHCD recommends that the Hawaii County Housing Agency approve the attached resolution authorizing the OHCD to enter into a multi-year lease and the attached amendment to the operating budget to allow the OHCD to execute a lease agreement. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter placed onto the next Council agenda for review.
