RESOLUTION NO. 192
RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL
YEAR AND MORE THAN ONE FISCAL YEAR FOR A MULTI-YEAR LEASE OF
REAL PROPERTY FOR THE EXISTING HOUSING DIVISION OF THE OFFICE OF
HOUSING AND COMMUNITY DEVELOPMENT
WHEREAS, the office space occupied by the Office of Housing
and Community Development, (OHCD) is too small for their current
needs; and
WHEREAS, the OHCD has unsuccessfully worked with the
Department of Public works for the past nine years to locate
office space within a County of Hawaii facility and has not
been able to locate suitable office space for the OHCD; and
WHEREAS, the OHCD, as an alternative, has located suitable
office space to relocate the Existing Housing Division of the
OHCD to operate the Section 8 Rental Assistance Program; and
WHEREAS, the OHCD has located approximately 5,900 square
feet of suitable office space and 1,400 square feet of storage
space at 1990 Kino'ole Street, Hilo, Hawaii, which is adequate
for its needs and will be coordinating their services with the
State of Hawaii Departments of Labor and Industrial Relations
and Human Services, who provide similar social services to the
public; and
WHEREAS, Section 10-11 of the County Charter requires that
any contract, lease or other obligation requiring payment of
funds from the appropriations of a later fiscal year and more
than one fiscal year, be approved by resolution; and
WHEREAS, the County wishes to enter into a ten (10) year
lease for office and storage space through Kaneshiro & Sons
Enterprise, Ltd., beginning December 1, 2004, or upon the
submittal and receipt of the Occupancy Certificate by Lessor,
whichever occurs later and ending ten years thereafter, at an
approximate cost of $5,300.00 per month plus applicable general
excise tax. The approximate cost includes common area
maintenance cost.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY
OF HAWAII, that the Mayor is hereby authorized to enter into a
multi-year lease agreement for the Existing Housing Division of
the Office of Housing and Community Development;
BE IT FURTHER RESOLVED, that sufficient funds be budgeted
in future fiscal years to cover the anticipated obligations of
the County under the lease agreement;
BE IT FURTHER RESOLVED, that the Mayor, or, in his absence,
the Acting Mayor or authorized representative, is designated to
act as the representative of the County.
BE IT FURTHER RESOLVED, that a copy of this resolution be
transmitted to the Office of Housing and Community Development.
