RESOLUTION NO. 1J3 0~
RESOLUTION AUTHORIZING THE MAYOR OR HIS DULY AUTHORIZED
REPRESENTATIVE TO NEGOTIATE AND TO EXECUTE NECESSARY DOCUMENTS
WITH CL&D FIVE, LLC, TO SATISFY CONDITION "K" OF ORDINANCE NO.
02-113.
WHEREAS, CL&D Five, LLC (CL&D) is the owner of
approximately 9.75 acres of land at Hienaloli 2nd, North Kona,
Hawaii, covered by tax map key (3) 7-5-10: portion of 65; and
WHEREAS, on September 25, 2002, Change of Zone Ordinance
No. 02-113 became effective by changing the district
classification from Agricultural (A-Sa) to Single-Family
Residential (RS-20); and
WHEREAS, Condition "K" of Change of Zone Ordinance
No. 02-113 requires compliance with the requirements of
Chapter 11, Article 1, Hawai i County Code, relating to
Affordable Housing; and
WHEREAS, residents of West Hawaii cannot find affordable
housing units to purchase or to rent; and
WHEREAS, pursuant to Chapter 11, Section 11-4 (c) of the
Hawaii County Code, the Hawaii County Housing Agency has
adopted HCHA Resolution No. 136, directing that CL&D Five
satisfy Condition "K" by producing affordable housing.
NOW, THEREFORE, BE IT RESOLVED BY THE HAWAII COUNTY
COUNCIL that the Mayor or his duly authorized representative is
authorized to negotiate with CL&D Five, LLC, and to execute
necessary documents to satisfy Condition "K" of Ordinance No.
02-113.
BE IT FURTHER RESOLVED, that this resolution shall take
effect immediately.
