ORDINANCE NO. U4 53
AN ORDINANCE AMENDING CHAPTER 21 OF THE HAWAII COUNTY CODE 1983 (1995 EDITION),
RELATING TO SEWERS (LATERALS).
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF iiAWAI'I:
SECTION 1. Purpose. The purpose of this measure is to allow for an equitable settlement to landowners who
have been required by the County to construct lateral to their property in order to receive the final inspection approval from
the County.
SECTION 2. Chapter 21, Article 3 (Sewage Works and Connections), Division I. (General Provisions),
Section 21-14, (Laterals) is amended to read as follows:
Section 21-14. Laterals.
A lateral shall be installed to provide service to each lot in accordance with section 21-22. When a lateral is
required by the county in order for [he landowner to receive the final inspection approval, the county shall
construct the lateral within six months from the date of the requirement.
SECTION 3. Chapter 21, Article 3 (Sewage Works and Connections), Division 3 (Laterals), Section 21-2Q
(Application) is amended to read as follows:
Section 21-20. Application.
An application for a lateral to a lot shall be made on a prescribed form to the bureau of sewers. If the lateral
has not already been run to the property line, the County will construct it as soon as possible at the expense of the applicant,
except as provided by section 21-14.
SECTION 4. Material to be repealed is bracketed. New material is underscored. In printing this ordinance,
the brackets, bracketed material and underscoring need not be included.
SECTION 5. If any provision of this ordinance, or the application thereof to any person or circumstance, is
held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect
without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable.
SECTION 6. This ordinance shall take effect on the date of its approval.
