MEMORANDUM

RE: Bill 255, Draft 2 -Proposed Charter Amendment re County Auditor
At my request, Bill 255, Draft 2, was referred by the Finance Committee at its meeting of
April 19, 2004 to the Public Works and Intergovernmental Relations Committee (PWIRC) for
further review. The PWIRC met on May 4, 2004 and reviewed the opinion from Bobby-Jean
Leithead-Todd, Deputy Corporation Counsel. I ask for your concurrence to defer this bill at our
next PWIRC meeting on May 18, 2004, for the following reasons.
First, we have two conflicting points of view between the Corporation Counsel and the
Department of Civil Service regarding the applicability of civil service laws to positions created
within the new office of the County Auditor, as well as the issue of collective bargaining.
Attached for your reference are letters dated April 19, 2004, and May 4, 2004, from the
Department of Civil Service and the Corporation Counsel, respectively.
Second, this proposed reorganization to create an Office of the County Auditor will have
impact upon the organization of our current Office of the Legislative Auditor. This impact on
the employed staff of the Office of the Legislative Auditor is not addressed in this bill and should
be part of any proposed legislation.
Third, I believe that the Office of the Legislative Auditor is efficient and effective in
exercising its functions. This is demonstrated in the depth of research and analysis currently
provided by the Legislative Auditor and staff.
In sum, I believe this bill should be deferred until the issues concerning civil service are
resolved and a complete reorganization plan is addressed and reviewed by all concerned parties.
