MEMORANDUM

RE: Resolution 194-04, Draft 2 -Resolution Authorizing the Acquisition of Land for
the Puna Emergency Access Road in the Ainaloa Subdivison and in the Hawaiian
Acres Subdivision
Enclosed for your consideration is a proposed draft 2 which corrects the tax map key
identification of affected properties in the title and clarifies the applicability of Section 2-10 of
the Hawaii County Code in the third resolved clause. The changes between the original
Resolution and drafr 2 are as follows:
A RESOLUTION AUTHORIZING THE ACQUISITION OF LAND BY EXERCISE OF EMINENT DOMAIN OR
NEGOTIATION FOR THE PUNA EMERGENCY ACCESS ROAD IN THE AINALOA SUBDIVISION AND IN THE
HAWAIIAN ACRES SUBDIVISION, KEAAU, DISTRICT OF PUNA, COUNTY OF HAWAI`1 ,BEING PORTIONS
OF TAX MAP KEYS 3-1-6-65:109, 3-I-6-4: Ol [ AND 1-6-13: 81.
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII:
BE IT FURTHER RESOLVED that in the process of said proceedings in eminent domain, the Office of the
Corporation Counsel be and is hereby authorized and empowered to negotiate terms of settlement in accordance with
Section 2-10 Hawaii Count, subject to the approval of this Council and the court before which such proceedings
are prosecuted.
