From Council Member Gary Safarik, dated May 22, 2002, transmitting the above resolution. Informs this resolution evolved out of a meeting he held with Mayor Kim, Corporation Counsel's Office, Public Works Department, and with the Ainaloa Community Association. Comm. 641.1: From Ainaloa Community Associated, dated May 15, 2002, stating their support of some of the stipulations of the Mayor's proposal to take ownership of the Ainaloa Boulevard with certain stipulations. Further, they agreed not to close the road again until the question of ownership is resolved by the County Counsel. Comm. 641.2: Copy of letter to Mayor Harry Kim, from William H. Coney, ['resident Ainaloa Community Association, dated May 21, 2002, stating their support of his proposal to gate the Puna Emergency Access Road with availability for use of emergency vehicles such as fire, police, rescue, ambulance, etc. Informs their only exception was in the wording, "use of the public for access or egress." States, if there is a tidal wave or lava flow endangering public safety, an escape route during a state of emergency is acceptable. Comm. 641.3: Copy of letter to Ainaloa Community Association from Councilmember Gary Safarik, dated May 23, 2002, expressing his disappointment over the reversal of the Association's original decision to turn Ainaloa Boulevard over to the County; however, honoring their wishes to defer the action. Comm. 641.4: Copy of letter to William H. Coney, President, Ainaloa Community Association, dated May 27, 2002, from Mayor Harry Kim, responding to his letter of May 21, 2002, stating he believes it is important that Ainaloa Blvd. remain open, and asking the Association to clarify the community's position on the matter. Bill 280: AN ORDINANCE AMENDING CHAPTER 3 OF THE HAWAII COUNTY (Draft 3) CODE, BY REPEALING ARTICLE 1 -RELATING TO SIGNS, AND (Comm. 774) AMENDING ARTICLE 2-RELATING TO KAILUA VILLAGE SIGNS (2002) REPEALS Article 1, Chapter 3, Hawaii County Code, which presently consists of 33 sections and REPLACES it with a new Article 1, which consists of 48 sections. A summary analyzinK the effect of the proposed changes on signs in various districts is contained within Communication 774 attached to this Draft 3. Major changes involve or include but are not limited to the following items or subjects: findings and purpose, definitions, renumbering sections, sign area, changes for clarity; type and number of signs, signs prohibited or permitted in all areas, exempt signs, fees and enforcement. This bill also AMENDS Article 2, Chapter 3, Hawaii County Code. Draft 2 of this bill proposed changes to 2 sections of this article, which relates to signs in the Kailua District. Draft 3 proposes numerous changes to this Article which involve or include but are not limited to: purpose, variances, definitions, the Kailua Industrial Subdivision, administration and enforcement, permit review, variances and penalties. Comm. 42.8: AN ORDINANCF, AMENDING CHAPTER 3, OF THE HAWAII Bi11280 COUNTY CODE, BY REPEALING ARTICLE 1 - RELATING TO SIGNS, (Draft 4) ADDING A NEW ARTICLE I -RELATING TO SIGNS, AND AMENDING ARTICLE 2 -RELATING TO KAILUA VILLAGE SIGNS. Comm. 42.6: From Lynn Puri, Sign Chair, Kona Outdoor Circle, dated March 17, 2003, urging passage of the Sign Code Revision, which she feels will clearly address the blight of illegal signs on the Big Island. Comm. 42.7: Copy of letter to Legislative Assistant Charmaine T. Doran, from Acting Building Division Chief Brian Kajikawa, dated June 20, 2003, responding to suggested amendments to the Sign Code submitted in letters from the Planning Department, dated February 20, 2003 (Comm. 42.2), and from Ted Persig, dated March 18, 2003 (Comm. 42.5).
