Ph/FAX (808) 323-8238 June 1, 2004 Mr. Gary Safarik Hawaii County Council Chsirman Public Works & lntergovernmental Relations Committee 25 Aupuni St., Room #209 Hilo, H196720 FAX (808) 961-8912 RE: BILL Z80, DRAFT 4 -OPPOSITION STATEMENT Aloha, 1 am writing in opposition of Bi11280, Aran 4 for the following reasons: Thia bill does not reasonably justify the proposed special restrictions which unfairly discriminates the 'Kailua Village Core' from other very similar districts such as the Hawl, Keinaliu; Punaluu, and Honokaa small business villages, This bill equivocally defines the boundaries for the `Kailua Village Core'; for example, designating a south boundary of Hualalai Road while the small business district clearly extends ' well beyond this arbitrary boundary. This bill discriminates based on business types and content of siEna without reasonablc justification; for example, exempting signs advertising events and selling real estate from the permitting process. w° This bill is ambiguous in regards to the identity of the `authorized personnel' charged with enforcement; and in view ofthe discriminatory additional restrictions proposed within the `Keilua Village Core' appears to provide a channel for a private minority to actively participate in unfarr disc~~tination toward small businesses within this area. I have operated a business within the Kailua Village Core for the past seven years; and during that short period, I have seen far too many small business owners close their doors under mounting debt and bankruptcy. I firmly believe that this bill, as wrimn, will serve to exacerbate the existing poor business environmem under the pretext of `protecting' the public good. I am appealing to the Council to please take action to support rather than unfairly discriminate, reatriat and punish the buairhessea within the `Kailua Village Core' area.
